On August 18, 2023, **** ***** and Hometown Support LLC were contracted to deliver 15 tons of #4 size gravel to my property in Philo, Ohio. Services were charged $450 and paid in full prior to the delivery on August 20th. 5 tons of gravel were delivered on August 21st. Now, more than three months later, the remaining 10 tons of gravel has yet to be delivered and **** has not responded to the numerous messages and calls.Initial Complaint

On November 15 they sent me an invoice for $275.00 for the cleaning the leaves in my yard. Unfortunately they did not finish the pickup and left a huge pile. They stated someone would contact me and no one has. I requested half of my money back and I stated I would pursue further action if not given my request. They said ok.Initial Complaint

Ryan (hometown support llc) was contracted to repair my roof damage, yard damage, gutter damage, yard drain damage, and siding damage. Part of the roof repair was a new metal roof and all associated seals. The work was supposed to start per contract on Sept 2. Work did not begin until Sept 6. During which time I have given him a deposit of $11600. It has been 3 weeks of work and the roof is not completed due to Ryan not purchasing all the materials. He has also tried to replace parts with inadequate quality and not designed for a metal roof. His employees have not been paid for any job in the last month. His estimate that I have been asking for was to replace my trusses with 2x10 trusses where he replaced them with 2x4 which it was supposed to be. He is over charging for materials at an amount not agreed to. Since he no longer has money to purchase materials for my job which have only come to an estimated $7000 according to all the receipts His foreman has. I have been having to pay sub contractors to get my gutters replaced, siding repaired, and my yard and drain fixed. He has dug up my yard drain and admitted he doesn't know how to repair it. And has been asking for the rest of the money for the roof which was not agreed upon in the contract. I have refused to pay it since the job is not complete. I have also contacted my insurance as he is sending in supplements that are over priced and a different amount than what we have been told leading towards what we suspect is fraud. I have contacted the state attorney generals office and filed a complaint as well as a lawyer that has advised me not to pay anything.Business response

This entire situation started because the customer told me he was not going to be paying the final check. He informed that drywall he wasn't going to do as well as sent me a message not to worry about the drain. Also the siding was taken out of deal so I informed the customer once the roof was done just pay us for the truss repair and the roof. Customer informed me he would not be paying me another dime so at the point roof was not completed. This is a insurance claim the insurance is the one who declares what the roof is worth to repair not him after he saw invoices of some..not all the material he declared I paid you enough. I even offered to take 1500 off the total bill due to mishaps on the job site. So yes I informed customer if he's not going to pay me at least pay the guys who had sweat tears and labor on his roof to finish the roof. Since he was not going to pay me. Also he has made false allegations that we started the job after start date I attached a screenshot showing we started before the contract date and was there doing the truss repair on his roof. We just simply want paid for the work that was done and move on as we speak one of my employees is still working on his roof.Customer response

The business breached the contract in multiple occasions. The insurance does set what my replacement is worth but the business is required to give an estimate which it did not. The contract states also that work will be started by Sept 2. And that any previous agreements written or verbal are null and void. The contract also does not state a price. When material alone was $6000 and they recieved $11600 as a deposit for all the work in the contract. Which included truss, siding, roof replacement and drain repair all of which was not completed in a timely manner per the contract. 4 weeks into the job and the roof was not close to being completed. The business had me buy material and paying their sub contractors because they didn't have the money to pay them or their employees. The did not even had adequate funds to put gas in their vehicle to get to the job site. There was over $5000 left over after material and no accountability as to where it went or why they didn't have it to buy the remaining material. The customer is not willing to pay a 125% mark up on materials especially since industry standard is 20% at most.

He is one of my employees still and was hired for job the payment of my men is none of his concern we all new no one was getting paid till end of job because we wasn't working any other job. I informed Mr ****** if he wasn't going to pay me be q good person and pat the men busting ass on roof and I will not take thisbto court and I will walk away the customers main reason for canceling contract was not valid started before date and only reason I didn't pay contractor was because at time of the contractor coming he ahe me was already disputing and he said he'd pay it at this point only solution I see is me putting contractor lean on property and customer fighting it in court roof is completely done I have messages from my employee how he'd still and was a employee during entire finishing of roof which is completed. I'm paying my employee for completing roof the customer was not neat police officer to hear me and three conversation because customer stole my property and my attorney is going to push for theft and damages as well since a hour before cop showed there was messages that the ladder was still thereCustomer response

I am rejecting this response because: this is not a solution to the problem. As of this date the rood is still not finished. The person working on the roof has stated multiple times that he no longer works with the company. As for the acquisition of theft of the ladder. It was left on the property by the owner. He stated he was going to get his ladder anyway possible. As we informed the officers the ladder was outside. When he arrived the contractor was knowingly trespassing on my property after being informed not to come on my property which was in text verbal and property is posted. While we were not home and in a different city for an appointment he stated the ladder was no longer there. All property of his was last seen the day before with no knowledge of anything happening to it. The fact of the matter is that the contractor failed to uphold his end of the contract in multiple ways and wants more money for a sub-par workmanship on his end. He has not treated this job professionally or responsibly. Especially when it has come to purchasing of materials and management of job funds. The contract states that the remainder of the balance is due at the end of the job which he failed to complete and failed to even get close to completing in 4 weeks. Industry standard for a roof this size is 3-5 days not 4 or more weeks. Same as mark-up on materials of 20% as Standard not 125% which would require a wholesalers license and retail license.
