On April 29,2023 I hired Justin ****** to build a porch and deck with stairs and ramp. By checking I gave him $22,411.29 that he asked for. This was for materials to start and finish the project. On May 15,2023 he wanted another $885.00 there's another check. On June 1,2023 another$2,800.00. After that he takes off for 3 or 4 days to fly him and his wife and 2 kids to Texas to buy a used pick up truck. He tried to get more money from me but I told him the bank is closed. I have already paid more than the contract stated which is $22,411.29. And all this time he says he can't get the materials because it is on back order. But it is funny because my son and I went to Menards in Cleveland Ohio and got the materials. More than once did we do that. So there is more money out of my pocket. On July 26,2023 I got skirting for $560. On August 4,2023 I got railing for$2,136.86. On August 8,2023 I got more railing at $509.09. Plus there was some stuff he took back and got store credit at ******* in Cleveland ,Ohio. He said I could not get it because it is in his name. He did not finish the job till the middle of August. I don't want him to treat someone else like this. I'm 76 years old on Social Security. I need the money coming to me. As I said before he will not take my calls. He has been seen in a bar flashing money around. So why can't he pay me. He admitted to me he owes me money.Business response

When I initially got hired by Ms. ****** for her home project, it was made clear that any changes in the project would be an additional cost, as well as any problems that may arise. I did, in fact, go to Texas with one of my children to purchase a truck. My current work truck had broken down with a very costly repair that would have taken much longer to fix than to go forth with replacing the truck I had. I had intended to buy a new truck in the near future, so the opportunity for me to replace my work truck came at an inopportune time. However, it was a necessity for my business and there was no logical way to postpone the purchase. For that “3-4 days” that I took off, I was working late evenings and weekends, as well. This includes both Saturdays and Sundays. No time was taken off that wasn’t replaced. As for the materials being back ordered, I was not willing to drive over an hour away to pick up materials that were needed for the project. Once again, that would have been extra money for fuel in an unexpected circumstance. It was never discussed that she would be refunded for picking up her own materials. Her impatience is what took her to another city to pick the materials up herself, not my incompetence. There was no time frame in our contract, therefore the fact that it took all summer to complete is irrelevant to the situation at hand. I even hired extra people to work on her project since she was complaining about the time, which caused an influx in cost for myself. After handling the cost of labor, it went back down to two workers, which was myself and another person. The second worker, whom is a male, kept avoiding work due to inappropriate comments and physical contact made by Ms. ******. I was there many days on my own. The entire time we were there she doted over the work we were doing for her and told us how much she was going to miss us when it was completed, although, I heard proof myself of her talking horribly about us when we weren’t present. After the project was completed, she loved the work we did and had no complaints in our presence, and no reimbursement was ever discussed. In fact, she tried to contact me to do more work for her, and it was at this time I chose not to communicate with her anymore.Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
First of all it was not made clear that I may owe more money. I was under the impression what the contract said was what I owed. As of him going to Texas. He told me he took his whole family. Wife and 2 children. As for his truck. If the truck was in that bad condition. Why was he able to give it to a guy (Anthony)that works for him as soon as he gets home and to this day is driving it. He did not work late hours. He came between 9 and 10 am and quite between 2 and 3pm. As for working on Saturday or Sunday. He only did that 2 times the whole summer. And there were a lot of times he didn't come to work at all. As for the materials. He told me it was all on back order. It's funny my son and I went to ******* at **** ***** **** *** Cleveland Ohio and got the stuff with know problem. This is also the same location he took me to get railing and it is 47 min. From my house. He tried to tell me that ******* didn't know where his order was. He also said that he would not go to ******* because it is run by women and he can not find anything. I have driven over the road truck and I worked in factories. I know there is a tracking code that will tell you exactly where the product is. Plus if he didn't want to drive to the store. The store would deliver it at a cost of $200. I would have paid. Just to get it done. As for my Impatients. Yes I was getting very impatient. I hired him April 17,2023. By this time it was August. This is a job that should have taken 4 or 5 weeks. Not 4 months.When he first started the job there were 4 people including him. After about 2 or 3 weeks he let 2 of the workers go. He told me he couldn't afford them anymore and he had to keep going over their work to make sure it was done right. This left him and Anthony. I DID NOT in any shape or form make any improper gestures it being language or touching. Justin told me he could not keep Anthony working because of Anthony's wife. What ever she said was what Anthony did. He would have to take her to the doctor all the time and it would last all day. This was done several times. And Anthony told me that is what he was doing. I am 76 years old and *** doesn't interest me one bit. Yes I did say they did a good job. And yes I did say once I was going to miss them. I mean after 4 months of them here. Evidently he doesn't recognize sarcasm. I did NOT talk bad about him or his workers. If he thought I did then he should have come to me and ask me. If he didn't believe me then WE could have gone to the person or persons who made the accusations on me. This would have avoided all of this. As for the money that is owed me. He is the one that told me he owes me over $200. The reason I contacted him to do more work was I figured if he owed me $200. He could take that money and buy me a high rise toilet put it in and I would pay for the labor. I figured that would make us even. He has so many lies in his statement it's not funny. And I just found out today January 11,2024 I did not have a legal contract with him. I just wonder if he even has a license? All of this statement is true and I do have witnesses.
