            Government Action: BBB reports on known government actions involving business’ marketplace conduct:

            State of Ohio v Craig O. Seitz, individually and d/b/a Franklin Golf Car Company, and Franklin Online Sales

            The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved.  We are providing a summary of the government’s allegations, which have not yet been proven.

            On Nov. 19, 2018, the Ohio Attorney General’s Office filed a civil lawsuit in Delaware County Common Pleas Court against defendants Craig O. Seitz, believed to reside in Worthington, Ohio, individually and d/b/a Franklin Golf Car Company and Franklin Online Sales, stating the defendant conducted some of his business from a location at 733 Lakeview Plaza Bvld., Worthington, OH, and from numerous websites including www.franklinsales.com, www.franklingolfcar.com, www.franklinagsupply.com, and www.franklinoutdoors.com., including the sale of golf cart parts and accessories, flags and accessories, and products related to the outdoors.

            Charges filed allege the defendant committed unfair and deceptive  acts in violation of state laws, including allegedly accepting payments from consumers for goods and failed to deliver those goods or refund consumers’ payments. In addition, the defendant is accused of failing to register or report the use of business names with Ohio Secretary of State, prior to doing business in Ohio under those names.

            The state is asking that the court to order the defendant to pay damages to injured consumers, and to prohibit the defendant from engaging in business in Ohio until he has satisfied all monetary obligations ordered by the court, and other relief as the court deems appropriate.

            The matter is pending.
