My husband and I closed on our home which was purchased from The Home Store in Muskogee in January of 2022. We were told the home would be delivered within the month. Due to lots of delay in the business side it was months before the home was delivered. Since delivery we have been going back and forth regarding the air conditioning unit that we know was used and we are ok with that but the unit was disconnected improperly and we cannot find any HVAC company to service and install it due to safety and licensing barriers. We have used windows air conditioning units all summer and struggled to be comfortable. Per HUD this delivered unit should have been in working condition and it is not per several professionals. The Home Store sent out "their guy" who told my husband and I he would recommend the unit we received be replaced for the same concerns as other disinterested companies. According to our last conversation with The Home Store they are unable to replace it due to the contract stating that they will deliver a "used AC unit." While I am not against a used unit, this used unit was not disconnected properly causing the seals and internal components to go bad and allow debris to contaminate the system. My husband and I would like to take all necessary steps to attempt to make this right per HUD regulations before we retain the attorney helping us. We hate to have to take them to court but if that is the step we take then we will. We are just asking for an AC unit that will work safe. We understand that we are responsible for the installation but no one licensed will do it with this unit. This entire process from beginning to now has been disheartening when working for The Home Store. I regret purchasing this home from them because of the way they refuse to take responsibility.Business response

Business Response /* (1000, 5, 2022/10/12) */ Mr. and Mrs. ******** closed on the purchase of their pre-owned home in January 2022. The home was delivered February 21, 2022. All pre-owned homes are purchased "As-Is" with no warranties expressed or implied. We are disappointed that the air conditioning unit that came with the home appears to be inoperable. We are willing to help the ********* find a resolution and will contact them again.
