      3/13/2023, over a year. Met w/ ***, speech on what they had to offer & how much we could SAVE by building our own. Wanted more than they offered, they said wait we can do that, that is called *** +Package just cost more. I'm interested! They left room, came back and said yes the boss agreed to $45,000 total package, for the house, ************ Coerced by the salesman, I agreed on everything they agreed to do & the price. House plans/disaster: Building permit/consultant didn't get the permit/s, I had to! *** said they would get bids, schedule contractors, schedule material delivery, check quality of workmanship to give final okay before a check was cut. Be Aware, *** doesn't care about the quality or if it was being done correctly, it's not their house, they just want to see that the work is done. *** didn't inspect for quality at all, they just saw that it was being done & was okay with poor quality of work. *** didn't help me with my shop, water, well septic, windows, doors, masons, brick order, *********, tile setter, nor any of the materials for these jobs. *** spent many hours doing the job that I paid *** to do. I stopped communication b/t *** in mid Jan. *** shows up to take pictures & take credit for work being done with contractors Ive hired & the quality of work theyre doing. I told consultant he may as well not even come out anymore. They have not followed through with what the *** salesman that sold me on the contract had told me. I do not want *** personnel showing up on my job site. I am very dissatisfied & feel like I have been lied to by a group of non caring, self centered individuals. I have reached out & left messages for *** the Builder that have not been returned to discuss the type of work that was not being caught & corrected by the consultant. This was a red flag of concern for me that no one at *** cares about the customer.

      We met with Mr. and *********************** on Friday, 3/22/24 at 8:00 am to discuss their complaint.  We advised client that the matter would be brought to our leadership team on Tuesday, 3/26/24 and will contact client with a proposed resolution.

      This is a written response asking to remove the hastily accepted response from ***** and ************************* that UBuildit supplied to the BBB and to reopen the claim against UBuildit.

      The ********** met with UBuildit on March 22 and we left feeling pretty confident that UBuildit was going to work with us on a Termination of Contract Agreement.
      Their Release Agreement was just another contract that  contained verbiage in the Confidentiality clause and the Non Disparagement clause that led to the Liquidated Damages clause stating:
      A violation of either the Confidentiality or No Disparagement Covenants will cause UBuildit and/or UBI to incur substantial damages and losses in potential future business and in amounts which are impossible to compute and ascertain with certainty as a basis for recovery by UBuildit and (b) that liquidated damages represent a fair, reasonable and appropriate estimate thereof.  Accordingly, in lieu of actual damages for disclosure and/or disparagement, the Clients agree that liquidated damages may be assessed and recovered immediately by UBuildit and/or UBI in the event of any violation.  Therefore, the Clients shall be liable to UBuildit, Timber Ridge Custom Homes, and Timber Ridge Home Designs for payment of liquidated damages in the amount of Seven Hundred Fifty and 00/100 US Dollars for each and every individual disclosure or disparaging statement.  Also Special Conditions that we will remove the BBB review and complaint.
      This is a threat upon us, the customer, we countered back asking them to remove all three clauses and they responded back with that will not be possible.

      The response from UBuildIt was not meant as a threat. It is our standard operating procedure for clients wanting to break our contract. Nor was it something special drafted for these clients. The mutual release we offered the client released them from the contract and from paying us our remaining fee due. We gave them three options. Sign the mutual release as drafted, continue with the contract as written, or third option was for us to proceed with lien process to collect fees due based on original contract. The client didnt respond to any option so we have proceeded with the lien on the property.

      As we stated earlier, we gave the client option to continue contract as written. They rejected that offer and asked us not to return to build site. This left us no other option but to turn over to our legal team which we have done so.

      May 4, 2023 ********************************* ****************************************************************************** ******************************* *************************************** Ubuildit Holdings LLC **** *********************** *************. ** ***** ******** Certified Mail and e-mail Re: Requesting a refund for ******************** fractional franchise Dear ******************************* and ***************************************: I am requesting a $10,000.00 refund for the ******************** fractional franchise agreement that was executed on February 6,2023 for illegal Ubuildit representation and disclosures, falsifications, false promises and lies.Right from the initial start of communication and inquiring on the Ubuildit franchise, even though I expressed my concerns of not being qualified, I was coerced and pushed to move forward with the ******************** fractional franchise assuring me that I would be helped and guided and this would be an easy successful endeavor.With hesitancy, and upon your request, I wired $10,000.00 to Ubuildit Holdings LLC on February 6, @ 11:58am ******* time before anything was even signed.Only afterwards, and not even disclosed was it to be known that there was a $500 per month technology fee that that was changed to $750 per month. Additionally, I was informed afterwards that to be successful in this business I would need to partner with a General Contractor. Furthermore, training was explained to be home based but was encouraged to fly to ******** for live training at my own expense.I was also promised that you were to help me to find the right General Contractor to be patient and that technology fees would be suspended until I received a customer in hand.In my previous email to you on March 6, 2023 at 10:45am ******* time, I have already expressed and outlined these concerns.I feel I was rushed, used and abused without any integrity as your experimental testee as being the first fractional franchisee that was sold by Ubuildit LLC This entire experience was nothing short of flowery false hope and false dreamy promises.Again, I am asking you to refund the $10,000.00 made payment back to me.If needed, I will escalate these claims to the Better Business Bureau and beyond and to my retained Attorneys.Feel free to reach out to me anytime.       *************** to you letter dated May 18 , 2023 to ****************************. First off , your letter was sent to the wrong company.  UBuildIt Holdings , LLC is the franchisor who signed the franchise agreement with *********************. In addition all of Mr ********** claims are 100% denied.

       

      ********************* was not coerced , not lied to , not given false promises , and was certainly not pushed to wire $10,000. I addition , ************************* and I have offered Mr ********** full support , guidance , and went so far as to try and locate Mr ********* a partner . We sent out emails to over 950 leads three different times over a 2 month period in hopes that one of them would produce someone willing to talk to ********************* about either a construction consulting job or a potential partner.

      The end of 2021 we hired ************************* from u built it. We paid him 70 thousand so far. He has completed messed my house up. It will not even passed final inspection. My window are not to code, floors chipped, bathroom mirror not even on site, back splash to the bathroom sitting on the floor, he cracked my brand new bathroom counter, see patches in paint. Corner curved. Foundation is off by more the 6 in. The whole end of the addition kicks out. Walls are not square. He put s**** holes in my brand new floors to keep it in place instead of spacers. I have ***** on my house now because **** refused to finish and fix his mistakes so I will not release the last 10 grand in escrow. He will not contact me now nor will he fix his mistakes that he knows he made.

      Dear BBB,

      While we greatly respect and appreciate your role in our community this is not a matter that falls under your purview. 

      For beginners their complaint is aimed at a fellow franchisee. UBuildIt-******** is a FRANCHISE just like these people were. 

      Their complaint is against UBuildIt Holdings - the franchising corporation. Also located in ********.

      The main problem is the following.   They only filed this complaint after being served papers for a law suit.  

      It is our understanding that they are being forced into arbitration IN ********.  

      There is no place for BBB service AFTER a law suit has been filed and their complaint is much later than the filing of the suit.

      Sadly this is now a matter for the courts only.
