My husband and I closed on our home on 11/10/21. During that time a mistake was made on the deed and it was never deeded to us. On December 8, 2021 The seller ***** ***** and us had to sign a correction so the deed to our property would be ours because they deeded ***** and ***** ******* primary home to us. They filed the correction to get ***** and *****'s property to them but never filed anything on our home. In November 2022 I was checking on the taxes and found that the property is still not in our name. I made Apex aware of the issue and was told that Mayes County doesn't change those things until taxes are ran. This was a lie. Even after that contact now it is the end of December and it is still not fixed.Business response

We strive to provide great customer service and a positive experience with every closing. This is the first I have heard of these issues and will work to have them corrected as soon as possible. I have reviewed this file with our closer and regional manager and discovered that we did, in fact, make mistakes. This is not how we like to do business, but we are human. As such, we are working to obtain corrective documents executed by the sellers in favor of the buyers post haste. Once these are executed, I will personally see that they are recorded in ***** County. Once the documents are recorded, the tax records will be changed by the county assessor and the transfer of title will be complete. Consumer Response /* (3000, 12, 2023/02/10) */ I contacted ***** County and it still is not corrected. Verified 2/9/23. Spoke with the County clerk. I want my closing costs back and this corrected. I am about to contact an attorney to sue errors and omissions and ask the court for compensation. I want it fixed and my closing costs returned. And, this morning, we recorded those corrected documents in ***** County. The deed from the ******* to ***** was recorded in Book ***** at Page *** of the records of the ***** County Clerk. This business acted maliciously and/or colluded with the seller in closing a escrow by giving the seller a portion of the funds and taking fees that were not a part of any contractual agreements. We have attached the contracts and i checked the amendments and Apex did not execute a escrow agreement. Apex took it upon themselves to cancel our escrow and paid themselves a cancellation fee (neither party would have ever agreed to) without any consent from the seller or buyer. Furthermore signatures from both parties are required to move funds from any escrow under fiduary responsibility. By not executing their portion of the contract they clearly didn't have the justification to move our deposited funds anywhere without a executed agreement. They charged a $5000 cancellation fee per asset which there were two involved for a total of $10,000 and sent $20,000 to the seller which they show in the email chain. ***Documents attached***Business response

Business Response /* (1000, 5, 2022/02/10) */ The complaining party entered into a real estate contract to purchase two parcels of real property. They deposited with Apex Title & Closing Services, LLC the sum of $30,000 earnest money. The complaining party refused to complete the transactions because they refused to send the rest of the funds necessary to purchase the property via wire transfer. We require all sums over $20,000 to be sent via wire transfer. After the sale did not close, and after expending over 100 hours of work on the file by our closing team, and over ten hours by our legal department examining the abstracts, scanning documents, reviewing surveys, etc., we paid the outstanding invoices to other companies which totaled $1,315. And Apex retained $7,700 to cover the time it expended on these files. The remaining funds were released to the seller. These monies were only released and paid to Apex and other vendors after the buyer received multiple notices and demands to close on the subject properties.
