      Burke was contracted to do a large remove-replace project, burke refused to make score cuts per the township code, failed to file a permit with the township and refused to (per industry standard) to make a score cut where the new asphalt would meet the old. Burke was told if his company was not going to do a proper job according to industry standard he should stop working to allow for a mutual resolution but rather abandoned the project, leaving the parking lot unusable, debris in the street. Burke was contacted by the local township and refused to speak with them and ended the call. Employees of Burke stated he forgot his saw and was bringing it but never did. Employees of burke continued to remove asphalt and tried to stand on an area not being removed to weight it down as their equipment was lifting up "good" asphalt. As a result, the entire parking lot is now loose and it would appear that Burke has no insurance. Burke has an expired PA HIC as well as expired insurance when referenced with the PA Attorney Generals office. RE: ** ******

      Everything the customer stated is incorrect. I am licensed and I am insured. My insurance company turned him down because his claim had absolutely zero merit.
      He asked for a cheaper job because he needed a new parking lot and wanted to save it for a few more years I wrote a contract to patch and seal and save his parking lot for a few more years, when we got there, he asked for a more expensive job. Then he and I agreed when I told him it would be more expensive. When I told him we wouldnt do extra work for free, He became very upset and asked us to leave immediately with the asphalt all over the ground. I went ahead and done as he requested and left his property as he stated.
      If he would like this resolved, I would like it resolved as well. He didnt mention any mutual resolution at the time Im only seeing it in his complaint here he also did not call me directly to resolve anything. 
      I will agree to do the cut in the area he was asking for for free if he agrees to pay upfront when we arrive with the check. And we will do the rest of the job as stated in the contract.

      I will be attaching proof of my license that he claimed I didnt have in this email

      I have been out of the office for personal health issues,  this should be re-opened as i have photos and a contract which i can share when i am in my office to support my complaint.  If i need to open a 2nd complaint i will.

      Date ; 5/12/2022 Amount: $595 Initially, seemed like a well-run family company. Responded to my email request for estimate within 30 minutes and Mr. B****'s son came out the next day. He did the usual high estimate, and then offered 20% off if I agreed to have it done the same day, which I did agree to verbally. While he left to get materials, I checked the website and found the "30% off" offer. When he returned, I asked for the same discount as was on the website, and he said he had given it to me. When I pointed out the $50 difference between 20 and 30%, he shrugged it off as a "math error." That should have been a warning sign to me, but I felt obligated since I had verbally agreed to the job. He worked for a few hours, while babysitting his younger brother in the parked truck. I had to leave prior to the job completion, and foolishly left him a check for the full amount. Second mistake - when I returned, I found that the cracks were poorly filled, areas of **** on the driveway were just sealed over (and of course very shortly thereafter flaked off), and depressions had been filled with mounds of patching material that was neither tamped nor feathered properly. I contacted Mr. B*******, sent him pictures, and was told he would return within the next few days to check the job. Third mistake - over the course of the next four weeks, I got the same promise four times. Each time, it turned out "things were too busy" for him to return (although it hadn't been so busy when the job was taken on the next day). I finally responded to him that it was clear he did not stand behind his work and was just stringing me along with his promises to return. Since then, complete silence. I am in the process of repairing the mess he left behind. I have spent about $80 on materials and at least 4 hours of my time on this. I would be satisfied with an apology and a partial refund.

      We do not warranty cracks. I did stop by and the driveway was sealed and patched as the customer wanted. This is a case of buyers remorse as it seems that the customer wanted his drive re paved and asked for a patch and seal price. Re paving would be the only thing that would get rid of the cracks but would cost approximately $5000 for the drive.

      I am rejecting this response because: his comment makes no sense and does not address the original issues.  I am assuming that he means that we both agree that his company is not worth hiring, but again, it does not address the underlying faulty workmanship.
