      I had a balance with the company that I had made payments towards. I paid $300 on 9/3 towards a balance I owed and the check cleared my bank account on September 8th. I never received another statement from the company. I also mailed another check for $300 on October 3rd. I was contacted by the owner of Tapper and Sons, Rob Tapper, on October 4th and he stated that he could not accept the check they just received and I needed to pay my full balance immediately. And if I did not pay my entire balance of $2268.01 that day, I would be taken to court. He was very intimidating on the phone. I offered to call him the next day with my credit card but he said that if I did not pay him THAT DAY, paperwork that was already headed to the courthouse, would be filed against me. I did not have my credit card with me at work. I was very upset and intimidated. I was able to have my elderly mother drive to my house to get my credit card information and called Rob back with the payment. The $300 on 9/3 was never applied to my balance. I contacted Rob on 4/25 and explained what I had. I stated he was having his accountant look into. He stated he would be back in touch by 4/27. He was not. I contacted him again on 4/28 and only got an email stating he would look into it.

      My side of the story is that we have done multiple jobs  for ***, and she never paid any of her bills in a timely manner and always took it upon herself to make her own payment plans. On this occasion of her complaint, we had received a $300 check and accidentally it was never applied to her account. Then she mailed another $300 check, then I called her explained to her that she wasnt on a payment plan, that it needed paid in full and I would void this $300 check and mail it back to her, which in a conversation with her, she stated she did receive the voided $300 check, she said the envelope looked like a third grader wrote it out. While I was on the phone  with her she gave me her credit card number to pay the balance off because if she didnt I told her I was going to file with the district court. Which I did not have to wait for her elder mother to go to the house to get the card. She then calls me on April 25th which is 7 months later to tell me she paid $300 more then she should have. I explained to her it would take me time to go through everything since its been almost a year. I also at that time,  I mailed her a good faith payment of $300 to give me time to go through her account. She admitted she received the $300 check but never cashed it because she did not like that I put good faith payment in the memo.

      I am rejecting this response because: The response from the company is not 100% true.  The first 2 service calls were paid immediately.  The third service call occurred on a Friday and was not paid immediately.  They had to come back out a few days later and perform more work, costly work.

      He did mail me my voided $300 check in October which I received in November.  

      I did in fact cash the check for the $300 refund.

      The $300 check that was mailed to the company and not applied to my account had "deposit" hand written on the back of the check.  The other check I mailed to the company that was cashed was stamped with the company name.
      Since I have received the refund due to me, this can be closed.
