I purchased a $525 personalized fitness program which was to include (12) 30 min in person sessions, access the the facility sauna and nutritional guidance. After my 3rd 30 minute session I still had not been given access to the sauna or provided the nutritional guidance like I had purchased. I began reaching out to the owner (Mika'il) who reassured me he would take care of it. By the end of the 6th session, I still had not received the additional services I purchased. While trying to resolve the issue, Mika'il blocked my calls, never responded to my voicemails, texts or emails. I was unable to to redeem my final 6 classes because of the owners actions and unwillingness (or inability) to provide the services I purchased. I am requesting a $262.50 refund for the classes I didn't use due to the business' inability to provide the services they advertised.Business response

I am Mikail the owner of Diverse Body Sculpturing incim responding to a complaint from a former client *********************** id number ************ came in to my facility on july 12th 2022 for a fitness consultation and joined my gym on august 2nd 2022he made a credit card payment that day in the amount of $525.00 and on August 3rd was reimbursed for the full amount from his insurance HsaHealth spending account and immediately started looking for ways to get another refund from my business.My company policy states we don't offer refunds, i felt like **** was trying to run a scam against my businesshe wrote a review on ****** about my company sent several emails and was harassing me through calls and textwhich i can send you the text spread showing that ****************** admitted he already was refunded.Please give me a call at ************Thank youDiverse Body Sculpturing inc7224 Germantown ave

I am rejecting this response because:I reject the business response and the accusation I was attempting to engage in HSA fraud.
I did not pay Diverse Body Sculpting to investigate suspected HSA fraud; I paid for a fitness program. The program I paid for was to include (12) 30 minute personalized fitness sessions with sauna and nutritional guidance. I only redeemed (6) sessions before the owner blocked my number and ignored all attempts to resolve the issue. Those (6) sessions didn't include what I was told was included in the package I purchased.
Attachment Sessions Follow-Up******** - is the 1st email I sent on 08/06/2022 expressing my partial satisfaction with the program but made it clear I wasn't receiving the full program.
Attachment Screenshot************* is the last text change with the owner on 08/14/2022 when he told me to stop emailing and texting him about business (ie my dissatisfaction with the program) before he blocked my number.
Attachments Partial Refund Request ******** AND Partial Refund Request******** are subsequent emails I sent once realizing the owner blocked my number and wasn't responding to voicemails I left.
These documents' dates coincide with the payment invoice provided by the owner. I attended class on 8/2, 8/4, 8/6, 8/9, 8/11, and 8/13 only. I did NOT redeem classes on 8/16, 8/18, 8/20, 8/23, 8/25, or 8/27 because by 8/14 the owner was uncooperative with my dissatisfaction in the program and stopped communication because he suspected I was engaged in a HSA scam (by his own admission) preventing me from redeeming the remaining 6 sessions.

My name is *****************************,I'm a representative for Diverse Body Sculpturing. This email is in response to complaint ID ********.The owner of Diverse Body Sculpturing has been in business for himself for over 16 years and with the gym for over eight years. During that time the company has come across people that might feel like our program is not a good fit for them. When a situation like that arises we are fair in our practices to ensure the customer is made whole since our contract states we do not give refunds.The customer can either finish out the remaining sessions or we arrange for them to take advantage of some of our other services we have to offer.In the case of ****************** he stated he was happy with our program then he wasn't. ***************** had a conversation with the gym owner and they came to an agreement for him to come in for three one hour sessions to use the infrared sauna. Our trainings for for 30 minutes, the three one hour sessions would have completed his outstanding sessions.The day ****************** was scheduled to come in for his first sauna session, he came to the gym to inform the trainer Sa'ood ********************** that he would not be using the sauna nor would he be back.***************** was blocked due to the excessive calling and emails he was sending. I run a respectable business and his behavior was unacceptable and harassing. I am rejecting this response because:as ***** confirmed in her response I was not satisfied with the program so they blocked my number, didnt respond to emails or voicemails, didn't provide my remaining sessions, and refused to issue a refund. This also contradicts the previous response from the owner.
I will not accept any response from this business until I am refunded for the 6 sessions I paid for and never received.

Thank you for providing a copy of ****************** response.
Clearly ****************** is looking for a refund however; per the contract he signed prior to joining the gym it clearly states we dont offer refunds.
As stated before he was offered alternative options to finish out his sessions which ,he agreed to and then on the dates of service he decided to cancel .
****************** was blocked due to his harassing behavior.

I am rejecting this response because the company failed to provided the agreed upon services/failed to honor the contract. I was blocked by the owner and my remaining 6 session were never redeemed or refunded. Had the company fulfilled their obligations I would have never have given them a 1 star review or filled a complaint w the BBB.
