I consigned an item to be sold at auction by Tribal Gatherings and it was sold on Dec. 26, 2021 for $120 via the LiveAuctioneers.com platform. Around that time I also consigned a handmade Mexican book by **********************************. Despite multiple emails and phone calls to Mr. ********* (all of which went unanswered), I have not been paid for the sale on 12/26/21. On May 11, 2022 I sent him a registered letter (which he received on 5/13/21) asking once again to be paid and to have the book by ****** sent back to me. That was almost 3 weeks ago and I haven't received the book, nor the payment.I can forward the email thread if that would be helpful.Customer response

I have received the letter in response to a complaint filed by a ** **** in regards to an unpaid consignment sale.
** **** has been paid in full and his property returned, you may check with him in regards to this statement.
** ****'s complaint that we sold the item in Dec is true, and typically we require a 45-60 day payout period. However his statement that we never responded to any of his contacts is false. In fact he states that he sent us more material in May ( which he states in his complaint) because of the high returns he was seeing from the sale of his objects. We spoke about the payment of the flute, which was approx $83.00 and he seemed to be ok at that point and I agreed that I would send it soon , as I was a bit under the weather at that time.
This does not make sense that he would send more material to sell if we were not in contact? I recall speaking with him on the phone a few times. Also, we never had a contract or written agreement, I did this as a gesture of good will, that was my mistake.
In any case, I was initially slow to pay for the musical flute due to health issues which I did explain to him , and I understand he is upset, but I do not believe a strike against our good name is warranted, all matters were settled weeks ago -before I received this letter.
Please let me know how we should proceed.
