      On April 5, 2022, the company sent me an email sales pitch through our nonprofits email system. In the email it says the very bottom I must email them back in order to unsubscribe and they do not have an unsubscribe option or button to click. On April 5 I sent back a response stating the following:We are a volunteer operated nonprofit and do not have the funding or need at this point in our scale for any additional solutions. Please remove me from your list.Today (April 12) another email came through from the same person ***************** following up on the original email and once again trying to sell me their products which do not have any fit for our organization. Since their company does not have an opt out process and asked me to respond to the first email which I did, the company is displaying poor marketing behavior and should be investigated. I would like my information deleted from their database and I would like ***************** to be investigated by their organization for his repetitive sales behavior a week after opt out. Telling people in your email that they just have to email you back in order to opt out is not a good business practice to begin with but even after doing so the company still a week later is trying to sell me the same product that does not have a use in our volunteer operated nonprofit.

      Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. 

       

      Leaving on vacation does not provide a resolution to this. If you are using automated systems that are operating when people are not even in the office then you cannot possibly be following normal business practices or applicable federal laws including the CAN SPAM act.  Your company should consider a better opt out process including the use of a single click mechanism at the bottom of the email to be removed from the database if you are not willing to monitor your incoming emails.  Under the same federal law, your company has multiple other things to fix.  Your subject line of **** x **** does not illustrate what is contained in the email and would be covered under the law as a deceptive subject line.  Also, your email does not contain your business contact information.  The law requires that you list your physical address in each email.

      Since the consumer is not able to directly *** or collect damages under the CAN SPAM act, here is a link to the federal trade commission website and their requirements for commercial messaging.  Hopefully your business will do better in the future.

      Again, we apologize for any inconvenience that we may have caused you. We now understand that the phrase "PS. If you don't want to hear from me anymore, just let me know." is not a sufficient form of unsubscription. I will personally make sure an unsubscribe button gets added as well as the subject line modified to be more inclusive of the subject at hand. We will also include the business address. 

       

      I have deleted your contact info from our database, so you will not hear from us anymore.
