      I called the dealer and asked to purchase the 2023 Kawasaki dirtbike KLF140RF that they had listed on their website. I spoke with Megan in Sales and she said it was still available. She informed me it was and after spending a lot of time and negotiating on a price, she took my deposit over the phone to hold the bike. She then called back afterwards and said the bike is being transferred to another one of its dealers so I cant buy it. I would like to be compensated for my deposit of $200 and for my time wasted with your dealership.

      Mr. ***** mistakenly lodged this complaint with the incorrect Velocity Dealership. He initially contacted our Orangeburg branch regarding the 2023 Kawasaki Klx140RF. Upon inquiry, he placed a $200 deposit, and the credit card transaction was completed on February 29th at 10:11 am. The manager, who was assisting him, later discovered that the dirt bike Mr. ***** desired had been sold at a different location within our dealership network. Promptly, she reached out to him and promptly refunded the $200 deposit. This refund was processed on February 29th at 10:43 am. Despite checking our inventory across all our dealerships, we regret to inform Mr. ***** that we do not have another comparable model available.

      Velocity Powersports Orangeburg called back and agreed to complete the sale as originally agreed upon over the phone. We took delivery of the motorcycle on 3/2/24. Thankyou to the Dealer for standing behind their agreement, and the BBB for providing a great forum for resolving issues quickly. This case can be closed.

      I sought to purchase a specific helmet for downhill longboarding from this business. They did not have this helmet in my size and strongly recommended a different model, which I accepted as based on their attestation that it was a good fit for my sport. I later learned that this particular helmet model is a motorcycle helmet which is ill-suited for longboarding and can actually increase chance of injury due to its weight. I sought to exchange this helmet for the correct model and was told after being given the runaround for over a month that returns of helmets are not possible for any reason. I relied on this business to advise me on the appropriate product, however was told that it was my responsibility to know what I needed. This is ludicrous and I will not stand for it!

      Business Response /* (1000, 11, 2022/02/07) */ The customer purchased a motorcycle helmet from a motorcycle dealership. The customer was advised before purchase that, while the helmet did meet many safety requirements, it was designed for motorcycle use. Furthermore, the customer was told verbally and in writing on the receipt that for safety reasons, we did not accept returns or exchanges on any helmets. Lastly, the customer has already filed a dispute with the credit card processor for "canceled merchandise/Services". The invoice with the return policy is attached. Consumer Response /* (3000, 13, 2022/02/08) */ (The consumer indicated he/she DID NOT accept the response from the business.) The business appears to be citing their alleged policies rather than events as they actually transpired. The bottom line is that I arrived at the dealer with the objective of purchasing a specific helmet for downhill longboarding. This helmet was unavailable in my size, and the sales staff recommended a different model that was "highly regarded", assuring me that it was suitable to my intended sport. I relied on their advice and completed purchase of this helmet. Contrary to the response by the business, I was NOT told verbally about the return policy but admit that it is possible that it was printed on the receipt which I did not review. I have no experience with motorcycling and it is not reasonable for the business to conclude that (i) I understood that I was purchasing a motorcycling helmet, (ii) I had frame of reference around safety concerns with helmet returns. Rather, I located the business on the dealer/reseller page of a multi-sport helmet manufacturer that I was interested in, relied on its staff to assist me further, then attempted to find a common-sense solution to correct the problem in a mutually beneficial way and was summarily ignored for over a month until receiving a curt denial on a followup. As for their comments about the dispute with my credit card, this was filed in tandem with this complaint and I do not expect it to be successful on its own as the business has not allowed me to return the merchandise. If the business does not fight the dispute and it is successful, I will consent to closing out but not expunging this complaint.
