      I went through them for a vehicle and got stuck with something I didn’t want but was promised a better vehicle at tax time came back with my taxes and he wanted me to pay on 2 vehicles so I went somewhere else and took the other vehicle back and a week later he took a payment out of $164.50at that point I didn’t have the vehicle anymore and I wasn’t through a bank I called the guy frank and he kept telling me they were going to refund my money back and I called multiple times and they’re was excuses every time as to why I hadn’t received it so I called and asked to speak to the owner about it and he told me he wasn’t going to give my money back due to the fact that I returned the vehicle and went to another place for a vehicle he was extremely rude and it’s not right to take money knowing I don’t have a vehicle through them anymore all I wanted was my money back which they won’t do I have submitted where I have contacted them I also tried disputing it through my bank but that didn’t work because there not in contract with them

      Customer financed a vehicle with us as lienholder. Customer signed a FZ-TN-RIC-SIA Retail installment contract in which they promised to pay for the vehicle over time. The customer did voluntarily repossess the vehicle however, this does not mean they do not owe the amount contracted. They felt they did not owe anything because they brought the vehicle to us and felt like we should pay them money back. That is not how a finance contract works.

      At this time, we have not turned them over to collection or processed a garnishment against them for the balance. This contract, protected by Tennessee Law clearly states the following;

      "If you default, or we believe in good faith that you are not
      going to keep any of your promises, we can demand that you
      immediately pay all that you owe. We do not have to give you
      notice that we are demanding or intend to demand immediate
      payment of all that you owe. We may repossess the vehicle; take
      any reasonable measures to correct the default, or save us from
      loss; or pursue any other remedy permitted by law in recovering
      the full remaining amount due. You will pay the reasonable costs
      and expenses of these measures, to the extent the law allows.

      We owe them nothing. It is clear that this is a repossession, whether voluntary or not, and the allegations serve no purpose or worth.

      I financed a vehicle and paid 1,600 down on a Hyundai Elantra 2017. Have been making payment since April 29th, 2022. Noticed car was dying contacted Thorpe automotive. Car lot took car to BigOs tire to be told nothing was wrong with car. I got car back and took it to Hyundai dealership to be told it was something simple so car lot paid for that fix. Left dealership and car continued to die. Took it back to Hyundai on June 29th, 2022 and it is currently still in there possession.. they said it needed a new engine. Dealership did further diagnosis and said we could try fixing something with the timing for 2,400$ and Thorpe would not pay for it. I tried to get a trade in in which Thorpe wanted 2,000$ down on a vehicle in which it I could pay that down I would fix the vehicle with the money. Car lot does not want help at all in this matter.

      Business Response /* (1000, 7, 2022/08/15) */ Before taking the vehicle to the Hyundai dealership, the customer stated she had a friend work on the vehicle that is not a certified mechanic. I believe, if memory serves right, she had him replace the cam shaft positioning sensor. We still tried to help however, she is still having problems and we can not see that they are pre existing. We sell all vehicles As-Is, and she has signed the as-is sticker and as-is form along with the arbitration form.

      On the 30th of december i went to thorpe automotive to try and trade in my 2006 dodge caravan which they gave me 800 for and asked that i pay 200 extra to put down. We got approved for a 2016 ford fusion and they let us drive it home with no gps or a closed deal with the bank. We notified the dealer that there were issues with the car when we test drove it and they blew it off and sent us out the door. Three days later we returned to have the gps installed and again notified the dealership of the issues the car and yet again it was blown off. They also let us know they had already sold my van before the deal was final. When the bank called (credito usa) they asked if the car was in good running condition and if i was satisfied i said no and the bank notified the dealership had to fix the issues with the car before the deal could be final. The dealership agreed and sent me down the street for an alignment. The alignment place called and specifically asked who they needed to charge for the alignment. I told them the dealership. We came to pick the car up only to notice that they did not do an alignment but just put tires on the car and said the problem was fixed. I called the dealership and asked them why they didnt do the alignment and they pretty much said that there was no issue, which i drive an older ford fusion so i know there is, and that the new tires should be good enough. I asked if i could return the car and get something else or possibly get my van back or at the least get my down payment back they said no. They said i had to pay for the tires they had to put on the car which did not fix the issue and also stated that if i bring back the car i would have to forfeit my down payment. The deal has not been finalized and i would like my down payment returned since they have already sold my vehicle illegally.

      Business Response /* (1000, 5, 2022/01/26) */ In response, The Customer signed a Bill of sale, a Buyers Guide, AS-is, and a Retail Installment Contract FZ-TN-RIC-SIA that all state the car is sold AS-IS. With that said, we found out two weeks after the sale she was unhappy and wanted an alignment. We sent it to a shop that stated it needed 2 tires so we had them install. Still unhappy, we sent it to a second shop and they stated it needed 2 front tires so we installed. Two different tire shops stated that it did not need an alignment so she said she would take it to pep boys. The appointment was set by her and then she refused to take it. She signed a CONDITIONAL DELIVERY AGREEMENT Form that clearly states she must adhere to all the funding criteria the bank asked for. She refused therefore putting herself in default. She also signed an arbitration agreement on page 5 of the contract. Asked to return the vehicle she refused. Once she refused we had to reach out to a recovery company to get our vehicle back. She brought a Police Officer with her when she picked her belongings up and implied one of our staff had stolen her credit card out of it. The vehicle had been locked the entire time and she was in possession of the keys. Once she unlocked the car her stuff was right where she left it. We are glad we have a police officer for a witness to that. Even after the way she acted we asked what she thought would be a fair refund. Her total down with trade was $1000.00. We paid for 4 tires, we had paperwork shipping by Fedex to and from the lender, we paid interest to our floorplan the entire time she had the vehicle, and we incurred $300 additional cost to recover our vehicle. When we asked what she thought would be fair, she started cussing and yelling at our staff and stated she wanted even more than what she paid down originally, once again with a police officer as a witness. He actually had to make her get in the truck she came in and leave the property. We were glad that she brought the police officer to hold the peace. We take complaints seriously. We try our best to please everyone however, sometimes that may not be possible. As you know we are an A+ ACCREDITED Member of the BBB. Bottom line is, we do not feel that we owe her anything and have truly tried to make her happy. Remeber, 2 different mechanics at 2 different shops stated that this vehicle did not need an alignment. We can get an alignment done for $60. we paid a lot more for tires trying to make her happy. It did not need an alignment and her actions were awful. Thank You.
