      I won 4 lots at an auction this past Sunday. The auction information/terms and conditions/ shipping and pickup information states" all items must be picked up on Tuesday, August 16, 2002 from X:XX-X:XX pm at ....." I had no problem with these terms and proceeded to bid. Monday night I was going through my emails and I opened up my paid invoice for the auction and within it it says "PLEASE SIGN UP FOR A PICK UP TIME BELOW:" I was completely unaware of this and upon opening the sign up the first hour was completely booked. I immediately reached out to the auctioneer in charge ******* ****** via text at 7:15pm stating that I was coming from over an hour away and needed to pickup my items at 2pm in order to be back to pick my daughter up from school. No response. I called at 8:38am tuesday morning, no response. I called again at 9:07am and ******* answered the phone. I explained again that I was unaware of the sign up and that it is not listed at all in the terms of the auction. She informed me that it is and got off the phone with me. I went back to double check in case I over looked it but it was not there. I reached out to ******* again at 9:13am and asked if she could please send over that information to me as I could not find it. She stated she would have ***** send it to me. I then told her that since it was not in the terms that I wanted a refund she quickly and rudely told me no and proceeded to hang up on me. No where does it state I needed to sign up for a specific time during this 4 hour window to pick up items I had already paid for. Even the email only asks that I please do, not that I have to. I followed the terms stated and had no problem picking up the items at 2pm. If you have to choose a specific time within the four hour pickup window that needs to be stated prior to bidding!

      Business Response /* (1000, 8, 2022/09/01) */ The auctioneer spoke with the customer 2 times on Tues, Aug 16. She stated that she need to pick up her itmes at 2pm because she had to pick up her kids at school. ******* told her she could come at 2 but if people were there that actually scheduled an appoitment she might have to wait. ******* proceeded to tell her that she could come after she picked up her kids at school and she would be there until 6:30pm. The customer called back and said she did not know there was a specific pick up time and she wanted a refund. ******* told her she could not issue a refund per the terms and conditions she aggreed to before bidding. Our terms state "All items not picked up at the designated pick up time will be considered abandoned property and will not be the responsibility of Parks Auction Co., the auctioneer or the seller. By resgistering for this auction, you hereby agree to these terms. If you find any of these terms unacceptable, please do not bid." The day of the pick up at 11:26am ******* text her to let her know her items were ready and waiting for her to pick up at 2. ******* still has the text on her phone. She did not respond to this text and did not come and pick up her items. Parks Auction request that you sign up for a time as a convience to the customer, so that they don't have to wait in line so long at pick up. She was never told she could not come at 2, just that she might have to wait if the customers that scheduled were there picking up when she arrived. The auction was over when she called the auctioneer and wanted a refund. We would not be able to resale the items she purchased. She purchased to large boxes of books, a box of candles and a box of halloween decorations. The seller sold these itmes on the online auction because they did not want them anymore, and if we issued a refund the seller would be left with the items. ******* tried her best to accomodate her. We can send copies of the invoice, terms and conditions and of the test message if needed. Thank you
