      In the last 2 years, we have received several postcards and a couple of phone calls about selling our home from this entity. So much so that on 2 occasions I have contacted the business to ask them to stop sending these cards and followed the directions to do so. In fact, the answer to the request stated our address would be removed. In our October 18th mail was ANOTHER postcard. I do not want to get a lawyer for a cease and desist unless it is necessary but I will if you indicate as much. Please stop this activity from this otterbuyhomes/***************************.       Hello,

      Thank you for bringing this matter to my attention. I am familiar with this homeowner requesting to be removed from our mailing list which has been done. I know that a lot of homeowners, myself included, receive postcards in the mail on a regular basis asking if they'd like to sell their home. These postcards are usually sent by Realtors and/or home buyers soliciting for business. Homeowner information is publicly accessible through tax records and it is a business owners right to solicit for business in this manner. With that being said, I always try to respect a homeowner's request to be removed from our mailing list and usually do so promptly. I see in my text msg history that this homeowner requested to be removed from our mailing list back on May 25th, 2022 to which I responded that I would do so. Unfortunately, I was travelling that day forgot to remove her from my list. This was an honest oversight on my part. She received a second piece of mail and requested to be removed on Aug 31st to which I responded on Sept 1 apologizing for the oversight on my part sent and I promptly removed her. However, my mail fulfillment center had already sent out a third mailing that she received on or around Oct 19th. I responded that I had confirmed her removal back on Aug 31st, but that third batch of mail was already in the fulfillment cycle. I apologized for the inconvenience and assured her that she would not receive another piece of mail from me again. Today I confirmed that my mail fulfillment center has removed her from our mailing list and was done so back on Sept 1st of this year.

      In regards to complaints of unsolicited phone calls, I believe that this homeowner has me confused with another Realtor or home buying agency as I do not solicit for business this way. In 2020 and 2021 I did solicit for business by phone, but it is often difficult to remove people that are on the *** list and therefore I no longer solicit for business by phone and have not done so since 2021. I believe that this homeowner has likely received solicitation calls from other home buyers, but has mistakenly associated them with me due to the postcard/mailer misunderstanding.

      I would like this homeowner to know that my failure to remove her from our mailing list was an honest oversight to which I apologize. It is not in anyone's best interest, mine included, to solicit for business from an individual has made it clear that they are not interested in your product.

      Thank you for bringing this matter to my attention. I sincerely hope that my response is satisfactory both to the BBB and to this homeowner.

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.
      However, while I didn't save the recorded message and do agree that other competitors may call I am almost sure that after listening to the full message I matched the number on the card.  But I will contact BBB again if I receive from any entity like this.
