Dear BBB, I am writing to express my dissatisfaction with the email listings that were provided to me by ******* ****** / Quality Solo Ads & Email Lists as part of our agreement. As per our contract, I was supposed to receive 5,000 business profiles for Dance SIC targeted for New England with 7 email blast within 2 weeks. However, the listings that were sent to me did not meet the necessary criteria and are not suitable for my business needs. Specifically, the email listings lack essential information such as company names, business contacts, and complete street addresses. This is in direct contrast to the sample they sent me prior to payment, which led me to believe that I would be receiving high-quality, qualified leads. I also felt confident when visiting their website ************** that they claimed to have “A” Rating with your BBB that was clearly located on their home page top banner. Now looking at your site and noticed that they do not have this rating with you and that I was misled by this false claim. (see attached screenshots) Due to this breach of our contract, I kindly requested a refund for the amount of $349.00 that was made via check on September 27, 2023. They are refusing to send me a refund even though we have not moved forward with this project. All they did was send me this email list that had been generated from @ hotmail.com, aol.com, gmail, yahoo, aim, comcast accounts without any business names. My company has done close to 50 email marketing campaigns for businesses and I have never had something like this happen. They haven taken advantage of me and I am hoping that you could help resolve this issue before I take further action to recover the funds owed to me. Dear BBB
As stated on our site when we sell contact information it is guaranteed to come with name and email addresses. If we have other details of the contact such as phone number, addresses, business names, ect... we will include it. We delivered the correct list as promised in excel but we cannot refund after the customer has possession of the list.

I am rejecting this response because:I understand that there may be limitations and disclaimers in a company's Terms and Conditions, but I did not actively agree to these terms, and there was no clear statement on their website indicating that the business listings/profiles may not include the information I expected. This lack of transparency is concerning. Under no circumstances would I ever be able to use this email list that was sold to me for qualified leads!
I would like to bring to your attention the misleading practices of Quality Email Marketing. They falsely claimed to be BBB Accredited, both on their website and during a phone call. I believe there should be consequences for using the BBB name on their website without authorization. I have attached a screenshot as evidence of their false claim. (please see attached screenshot)
Furthermore, I was promised business company profiles with a full address, as well as email services sent from their servers. Their representative, **** ****** even sent me a sample email list of businesses with this information, assuring me that it was what I would be receiving. However, I did not receive the promised business listings/profiles with email addresses. Instead, I received a list of individuals' first and last names, along with email addresses from various providers such as AOL, Comcast, Earthlink, MSN, and Hotmail. This does not align with email marketing standards for business listings. I have attached the invoice as evidence.
Attached to this email, you will find the invoice showing the services I paid for, which clearly specify business listings/profiles, not individual names and email addresses. I would like to request a refund for the misrepresentation of services and the false use of the BBB name on their website.

I reach out to customer and offered a 50% refund but was not accepted. We cannot refund once a customer receives the data. Out data is over 98% accurate.

I am rejecting this response because:I would like to clarify that I have sent a link two weeks ago to Quality Email Marketing for sending me an online payment as any indication for acceptance for the 50% refund. Never received any refund.
I can't account for your data not being accurate just that you sent me personal email addresses that were not sufficient for my needs. Clearly on my invoice and that **** ****** agreed to was to provide me with business profile listings. I specifically requested business profile listings and paid an extra fee for these type of listings that were not received.

We did offer 50% refund at the start before the client started the BBB complaint. The client went ahead and filed the complaint anyway. So there was no binding agreement for the 50% refund.

I am rejecting this response because:BBB I am rejecting - Due to this breach of our contract, I kindly requested a refund for the amount of $349.00 that was made via check on September 27, 2023. We then agreed to a settlement for 50% refund a payment link was sent to them. After payment wasn’t received in three weeks October 19, 2023 is when I opened this claim reaching out to BBB for assistance! We have never moved forward with any work for this project.

The client rejected the 50% refund offer and filed a complaint with the BBB Instead. Since the complaint has been filed it voids all refunds as explained to the customer.

I am rejecting this response because:This response is just another excuse for us not to get our refund. Honestly, we had given Quality Email Marketing an adequate window of time to refund our money. We tried contacting them through emails and phone calls that had not yielded with any results, escalating this matter to the BBB was necessary to seek a resolution.
I am on a limited budget for my email marketing campaign services that were promised. The $349 amount paid to Quality Email Marketing was to help my business grow and bring in new clients. Because of their lack of commitment in providing me with business email listings and seven emailing’s has delayed and impacted my business for these past three months!Regards,

The client already rejected our offer by putting the complaint in also once a digital item has been sent it cannot be returned. We tried to resolve this at the beginning but was rejected.

I am rejecting this response because: I am not satisfied with this decision from Quality Email Marketing and **** ****** to not refund any money I paid. They didn’t meet expectations with providing business listings in addition never included services for sending out emails.
