      I joined the gym on August 31, 2022 under a 12-month contract. On August 2, 2023 I sent an email to cancel my membership but was told my matter was handled by a different department and they would forward my request to the correct place. The next email I received stated that I had to go to the gym to cancel my membership in person with a signed and dated letter. I then called the gym several times and left messages, with no response. Next, I attempted to contact the gym through a portal provided to all members on October 5, 2023. Again, I received no response. I continued to be charged so I filed a dispute with my credit card in November 2023. In December 2023, I received a notice from my credit card stating that I lost the dispute due to the fact that I never cancelled my membership by either mailing a signed and dated letter or going to the gym and providing it. After this dispute, I sent another email to the gym on December 12, 2023 with yet again, no response. On 2/23/2024, I was finally able to physically go to the gym and I requested a copy of the contract I signed. I also officially provided the signed and dated letter cancelling my membership. However, upon review of the contract, it stated under #7 that, "All programs continue on a month-to-month basis until you cancel in writing via email with a 30-day notice prior to the next billing cycle. It is important to note, that #5 of the contract states, "I may cancel this agreement at any time prior to midnight of the third business day after the date of this agreement. To cancel this agreement, I must mail or deliver a signed and dated noticed which states that I am cancelling this agreement along with the address to the gym. I believe my credit card company mistakenly looked at #5 of the contract rather than #7. #5 of the contact is to cancel the entire agreement while #7 is to cancel after being a member. I am due $468 which is the amount I disputed. Please help me recuperate my funds.

      I have tried canceling my membership with The Camp Transformation Center in McKinney, Texas for over 2 months now, and I am still getting charged. I put my notice on July 7th, 2022. No one registered my notice and I was still charged. The following week I card to inquire again, and was promised I'd be able to cancel in 3 weeks. They have a policy where you are charged 3 weeks after you want to cancel. So I was charged 3 additional weeks, 4 weeks total, since they made the mistake of not registering my cancellation. But still the employees did not care about that. I should have had the last charge on July 29 at last, but I have been continuously charged throughout the month of August and now into September. It's become hard to get the employees on the phone to speak with me and I have to resort to going through my bank to track down my money. They are evading me and unlawfully taking my money because they refuse to process my cancellation.

We have cancelled the clients membership but the client NEVER provided us with a cancellation notice. She was made aware to send an email (which sounds like what she is saying in her complaint) but we have all the evidence that she did not. If she did, we would like a copy of that to address it and make it right to her.
