*****************, the owner of TXVinylFencing has repeatedly ignored my requests for proof of purchase for the fencing materials for a fence installation contract we signed. He cashed a $5829 'deposit' from me on Jun 13,2023. He said it would be 6wks to get the materials. That was 3 months ago and he continues to give me excuses as to why he won't install the fence. He set 2 dates for installation but has not come to do the work. This last date 9/18 - he claims now that the 'materials' aren't in yet. Other complaints have come to BBB since I gave him the deposit, he was also successfully sued in a civil case a few months ago. This person is a conman and a criminal, he claims he was licensed and bonded but he is not. I don't understand how this business only has an A-, he shouldn't be allowed to do business anywhere anymore.Business response

Since this complaint was posted, we have spoken to the customer and provided the necessary documents to proof to her that the material was order and that is in transit to her property, and should be arriving in the next few days. Sometime custom products do take longer than expected but her material and work should be completed next week.Initial Complaint

I hired Texas Vinyl Fence LLC (TVF) and owner ***************** to replace and install wood fence in yard for sum of $15,068 dollars in February 2023 per Work Order (WO) dated 2/19/23. TVF failed to honor with proper installation and didnt deliver requirements (cedar board trim) of the *** During installation, TVFs crew of inexperienced and unqualified workers with no fence experience, made multiple major install errors requiring repairs during the process, which were still never done properly after completion. The crew of TVF was inexperienced and sloppy resulting in a a poorly installed fence, protruding dangerous nails, sagging gates, sagging boards, uneven cuts, warped boards and other gross deficiencies which have come to light in subsequent months. TVF is unable to repair the deficiencies due to inexperience of employees. I complained to TVF and **************** who refused refund money ($15,068) and/or pay to have major deficiencies repaired ($5,900) by another skilled fencing contractor.Business response

We were hired to install a wood fence and to do the staining by ******************** on 02/20/23. The actual work was done and completed over the week of February 27th. ******, the supervisor for the project has over 30 years experience in the fence industry and worked with ******************** throughout the entire project, making sure that ************************ request for changes on the heights and placement of the fence were done to his satisfaction. ******************** wanted to be in control of the project from day one regarding every detail, so I as the owner spoke to ****** and advised him to have patience and work with ************************ demands and changes during the project. We provided all the agreeable material as described in the contract. We finished the project and got paid in full by ********************. On June 21, 2023 I received an email from ******************** about defects that he found. We walked the project with him and agreed that parts of the fence and ***** needed to be corrected and we were willing and able to fix these issues at his convenience. I reminded him that we offer a TWO YEAR LABOR WARRANTY IN WRITING, so he had full protection against labor defects that most likely appear during that time. ******************** never gave us the opportunity to fix the areas of concern that were discovered after the final installation. He decided to hire another fence company to do the repairs and now he wants us to pay for it. We don't claim to be perfect, or say that mistakes are never made, but we do stand behind our work and always attempt to fix any errors. That is why the TWO YEAR LABOR WARRANTY is included in the written contract. What I can say is that every customer is different and has a different expectation, so we try our best to work with everyone of those customers and give them the best service for their money. I am rejecting this response because: there is financial consideration/reimbursement offer to replace the entire fence defects from his crew's negligence. His crew is incapable of doing the work properly. It's all documented. Warped boards, crooked fence posts, exposed nails - it's dangerous. We had to hire someone else to do the work. We filed a lawsuit against Texas Vinyl Fence last month to recover damages.

I hired the company to take down the fence between the two homes and extend the fence to even it out. I also hired him to stain the fence. He left a post up from the old fence and the stain in my opinion is awful. I emailed him stating I was unhappy with the finished staining job and that maybe my expectations were to high. Two days later, I still havent heard anything back from him so I sent a review of his work on his page. He finally responded and said the fence was stained with the color I picked out. I didnt deny that but he also said he would come out the following week to look at it. This email was sent on a Thursday. All week I waited and that following Sunday after he did not show up and no communication stating he could not come. As far as I am concerned, he lied to me. I told him at this point the only thing that would satisfy me is being refunded for the stain work. I will deal with the post. He took down the neighbors so I do not know what the issue was of completing the job. After not showing up, I told him I do not want him on my property.Business response

We were hired to add a section of fence and a single gate between ****************** and his neighbor, the other part of the contract was to stain the new fence and gate and also his existing fence that is probably a few years old. We applied the stain color as agreed on both areas, the new and old fence. But when you stain a piece of wood that is new and has not been expose to the sun ultra violet rays is going to stain differently than a piece of wood that has been expose to the weather and has aged. I tried to explain that to ****************** an offer to stop by on a couple of different dates by he got very upset because I could not stop by when he wanted me to come by his house. Unfortunately I was out of town on vacation during those dates. Last time we tried to communicate with ****************** he was very aggressive during the conversation and asked me never to stop by his property. He has posted a couple of negative reviews on line, It is hard for us to work and communicate with people that are not reasonable.Customer response

I am rejecting this response because:I am not happy with his response. For starters, he stated he picked a couple of days to come out and I only have 2 responses about coming out. I have an email dated August 8, 2022 stating he could come out next week. He did not give me a date or time but I made sure I stayed close to the house for that week. He stated he will come out but he needed to be paid the remainder of the amount due which I did pay him at that point. It is now August 21, and I have not received any communication about him coming. I sent him an email and told him he does not respect customers time. I told him I would not be home on the 22nd of August until about noon. He sends me an email Monday morning stating that is when he was going to stop by. So, no, He did not discuss any specific days with me to stop by. I have emails to prove that.
Plus, he did not finish taking done the old fence. I have a post that is still in the ground from the previous fence. They took down the others to include my neighbors. He got paid in full and did not complete the job nor am I happy with the stain work. At this point, I called him and told him I do not want him on my property and I would take further actions. His response to that was he has dealt with a lot of angry customers like me which is a problem if he makes so many others upset with his service.

I will be glad to send one of the workers out to remove the post that ****************** has mentioned, I don't want to come out to his property because he seems to be very aggressive and vocal, regarding the stain I'm sorry that he is not happy with the final results, but we can't make and all fence stain the same as the new area.Customer response

I am rejecting this response because:
He had more than ample time to come and look at the finished product on his time that he was available. For what ever reason, he chose not to come out without any form of communication. I am just very frustrated at the service of the company and timely responses back. The BBB had to send him a reminder to send a response after 10 days because he failed to respond. The job with taking away and building the new fence was not completed properly leaving one of the old fence post up. My only satisfaction at this point is to receive a partial refund for not completing the fence work and complete dissatisfaction of the stain. He keeps bringing up the age of the fence and the new one. The old fence is only 2 years old. I understand that but that is not the issue. It is the issue of either stain quality and poor application of the stain. I would like half a refund of the stain work back plus a little for my time just like he got paid for his. The quote was for ****. I would like ****** back which should still more than cover cost of personnel and stain.

I am rejecting this response because:He had an opportunity to do that and he choose not to come and look at my concerns on his time window he gave me. I believe we are at a standstill and leaves me no choice but take him to court. I will contact my attorney at this point.
