      date of transaction January 9th 2024 I made an ******* deposit to buy a house from legends home on a contingency of selling my current house. I went under contract to sell my house but the buyer ended up cancelling the contract. I sent a message to the sales rep ********************* letting her and the loan officer ***** know about the situation. the sales rep ********************* then called me on April 1st after sending her several messages that I should received my refund by April 1st of 2024. I didn't received any check. I have then send her several messages but she is not responding to me at all, I went to the office several times but she was not there so I left a message for her to call me back. she called and said the check was return back to them and is sitting as a credit and i told her to issue me a refund, she told me to send her an email with the date my contract for my house got cancelled, I sent her that email and I have sent 24 messages and two email to her after that but I never received a responds back. I feel disrespected and I have honestly regretted my decision of buying my house with them. I need my refund of $2000 back . the fact that there was a contingency in the contract, I should be REFUNDED. please help. can I take legal action against the builder ?

      Good afternoon,

      Legend Homes has had the Boafo family under contract three different times, 10/7/23 on *******************, that contract was cancelled due to the purchaser wanting to transfer homesites, ******* money was submitted on 10/7/23 and then was returned due to insufficient funds (confirmation# **********), there were no deposits to process. Then on 12/26/23 at the property on ****************, ******* money was paid on 12/26/23 and then returned on 12/28/23 due to insufficient funds (confirmation# **********), at this time the Boafo family needed to sell their home as well as have a job offer letter for ***************, which they were unable to get us a contract on their home or the job offer letter, so the contract was voided out on our end, again there were no deposits on file to process. On 2/7/24 our salesperson received an update from the Boafo family that they had their home to sell under contract and a hospital picked out for ******************* job offer, at this time ************** had already re submitted an ******* money payment of $2,000 that was not returned and due to the information provided and with the ******* money going through, a new contract was sent out on 2/7/24 that was signed by the Boafo family that stated that the contract was not contingent, and the contract was ratified by Legend Homes on 2/8/24. We did receive the home to sell contract dated 2/6/24 that satisfied the non-contingency for our contract on ****************. The Boafo family was supposed to get the job offer letter into the lender however as of 3/1/24 we did not receive confirmation that the job offer letter was received. On 2/23/24 Legend Homes sent a non-compliance letter for the Boafo family to send the job offer letter to the lender by 5pm on 2/29/23 or the contract will be terminated with all deposits retained, the letter was viewed, but not signed by the purchaser, see attachment via DocuSign. On 3/5/23 a final notice of termination was sent out by Legend Homes for the termination.

      I am rejecting this response because: when I received the non compliance notice I called ********************* and she told me to disregard it, she said it was an error in the system so I should not sign it. See attachment of her messages. She also told me the contract was on contingent to selling of my house and the person buying my house ended up terminating the contract. I contacted ****** immediately the contract got cancelled and she said she will contact admin and issue a refund of my ******* deposit by April 1st. After that, I sent her several messages, and she would only respond when she wanted to. See the attached messages sent to her. I need my refund.
