The job Performed at ************************************************************, by Northern Asphalt on July 29, 2021, is not up to the standards agreed upon per the estimate. The estimate states that specific line items would be performed, and I was invoiced for the work exactly stated on the estimate. Even though the 1-year warranty was 2 months past, the work was not completed as stated in the estimate and invoice. These are the items I am disputing. (I have attached a copy of the estimate and invoice)-Install and process asphalt to 3 average compacted depth up to 12 tons. The whole area that was repaired parallel to the house is not even close to 3 compacted depth.-Hand tamp and shore edges as needed. The edges were not hand tamped and shored, causing cracking and disintegrating all along the repaired area. Attached you will find 2 pictures of the edges that are cracking and disintegrating.-Hot tar seams as needed. After the repair, the whole driveway was sealed without hot tarring the seams which would allow water to seep under the asphalt and cause damage. These all were noticed after the first winter. I placed several phone calls and was finally able to talk to someone. I complained that the job was not completed as stated in the estimate. I sent several pictures of the cracking and disintegration due to faulty work. After several calls, they finally agreed to come and hot tar the seams. This is the work that should have been done before the final coat, not after. This left unsightly black wiggly lines all over the driveway. I take pride in my property, and this work is unacceptable.I have tried several times through email, phone conversations and in person visits to get my issues resolved. I asked to speak with the ******* on the job (***) and was told that he was no longer with the company due to unsatisfactory work.I have since asked specifically to speak with someone with authority several times to come and look at the mess they left and have gotten no response.

      Regarding this customer..

We performed this job per WSDOT industry standards. The exact areas of Patching were done per his estimate.

      The dimensions of the areas were 62 x 5  and 60 x 4

We saw cut the failing asphalt, installed rock and paved back at the 3

We do not even warranty patches as we have no way of supporting the subbase of the entire driveway unless we prepared it. WE did not remove his entire driveway of asphalt and we were not the company that did initially.  We went and took out two locations that were failing.

We actually went over the asphalt estimate by 3 tons. Total asphalt used was ***** because we sawcut a bit more area as we felt it needed.

As attached, he signed out finished deliverable and marked EXCELLENT on all categories.

Per industry if a customer is Sealcoating right after we cannot tar seams as the sealcoat will not adhere to those areas.

He hired our sister company Superior Asphalt, and they performed the sealcoat on 08/09/2021.

We heard nothing from him until 09/2022 stating areas didnt get tarred and wanted it done. We didnt argue as to why nor charge him. We are reputable and went right out and took care of tarring the areas he asked us too.

Then he kept coming into our office demanding we redo his entire driveway, when none of these complaints were even brought up when he came in in September.

We ****** based off of what he asked, and he still isnt happy when that was his only first initial asked for.

He lives right by us and stopped in.

*** was not let go; he isnt employed here any longer. Again, another false claim of he was let go for unsatisfactory work. *** was employed 30 years with the Kitsap ***********************

Invoices state based off of final material and we didnt charge him being reputable company.

We do not feel he is valid in any complaint and by the attached you can see we have supporting documents to justify our behalf.

I am rejecting this response because:

The worked performed was not as stated in the estimate.  The thickness was not 3 ".

The reason I signed off on the work is because I couldn't" tell at the time that the work was sub-standard. The failures showed up after the second winter, which was 2 months after the warranty ended.

I did not hire the sister company, THEY did. It is obvious from the estimate and invoice that it was included. I had no idea another company was going to perform this work (sealing).

I was always very professional and did not raise my voice once. I did not DEMAND that they redo the entire driveway. I purposely made sure I was polite and did not yell or become confrontational.  My original request was that *** come out and look at the work that was done. That is when I was told that he no longer worked there. I asked many times to speak with someone with authority or the owner to come and look at the work that was done and was told every time that they were unavailable. When the crew finally came out to fill the cracks after many requests is when I was told that he was let go due to unsatisfactory work. I have no reason to make that up.

It is obvious by looking at the pictures submitted that the asphalt was not tamped along the edges leaving the edges to crack and crumble.

The pictures I submitted also show the work was not completed correctly and that a ribbon of crack-sealant was not placed between the old and new asphalt.
      Sincerely,
