I was going to purchase a motorcycle from this Harley ****** and I was told if I put the ****** down and decided to not buy the bike I would recieve a gift card for the ****** dollars I put down. When they found out I didnt want a bike from the ln they refused to give me the ****** dollar gift card. So he lied to me just to get me to put my money down.Business response

To Whom It May **************** letter is in response to a complaint filed against us with an ID of ********.
On June 21st, 2023, the customer who filed the complaint agreed to purchase (signed a purchase contract) a used 2021 H-D motorcycle with Appleton *************** and put a $500 deposit down to secure the motorcycle. At no point was he told or promised there would be a refund as a gift card (not a best practice) by the Sales Associate and the President/Owner, who was the acting sales manager, if he were to change his mind.
He was told he would be able to apply the $500 deposit to a different bike deal if he changed his mind as the customer kept going back and forth of whether he wanted a New or Used Motorcycle. ** prepared everything for him to take to his credit union, including a State of *************** vehicle purchase contract. The customer then agreed he would be in at 2 PM on Friday, 6/23, to complete the purchase.
The purchase contract is a commitment to buy the motorcycle from us. ** put a sold sign on the motorcycle, and took it off the showroom floor, and were committed to delivering the bike to the customer. Our sales associate had reached out Friday afternoon and Saturday, as we had not heard from the customer at all. ** finally heard from the customer on Monday, June 26th, stating he wanted his money/gift card back after buying a different motorcycle at a different dealership over the prior weekend.
That is in direct violation of the purchase agreement that was signed on June 21st, 2023, by the customer and ********************** ***************. ** have the signed purchase contract from the customer, and the customer was also given a copy at the time of signing. On the contract, we have every right to keep 5% of the cash price as a penalty if the agreement is not gone through, along with additional action for actual damages caused by breach of the contract. 5% of the cash price in this instance is $1479.17, but we are only keeping the deposit of $500. The $500 was a deposit in good faith, to purchase the agreed upon motorcycle at our dealership.
