      In Sept 0f 2019 I sold my trailer. Company was to remove trailer however took a month to remove. They left the deck on the property. Jacobs felt the need to charge me two months rent Nov and Dec also a fee for removal of the deck. I was told I could either remove the deck myself or pay to have them remove it. This removal cost was around the cost of my security deposit. In total Jacobs charged me $835 dollars. As of today 07/07/22 the deck has not been removed. If they were so concerned that the deck needed to be removed from the property why is it still sitting there. I know people who still live at the trailer park who would confirm Jacobs has not removed the deck. And to charge me two months rent just for deck sitting there is WRONG. I am not down in that area much but was recently and was angry seeing deck still there. They need to refund since deck was never removed.

      This is in response to the above referenced complaint.

       

      The complainant was not the owner of the manufactured home.  There was no contract with her.  Rather, beginning in **** and continuing until the end of 2019, the complainants mother leased a manufactured home lot from Jacob Homes Corp.  In keeping with your direction, this response does not identify the complainants mother.  She is referred to as the tenant.

       

      In the fall of 2019, the tenant sold her home to a third-party.  The purchaser chose to remove the manufactured home from the lot upon which it then stood.  Jacob Homes was not responsible for or involved in removing the home.  There was no agreement between Jacob Homes and the purchaser with respect to the home or leasing the underlying lot.

       

      After some delay after the sale, the purchaser removed the home from the lot.

       

      Prior to the sale, the tenant had constructed a standalone wooden deck in conjunction with her use of her home.  The decks dimensions are estimated at approximately 8 x 12.  The purchaser did not purchase the deck.  The deck remained on the lot leased from Jacob Homes following the purchasers removal of the manufactured home in November of 2019.

       

      The deck was a permissible improvement made by the tenant and was subject to removal by the tenant upon termination of her lease.  The tenant was advised of this.  When the deck remained on-site in December 2019, the tenant was billed for the continued use of the lot.

       

      Jacob Homes employees advised the tenant she could remove the deck or, if she wished, Jacob Homes would take responsibility for doing so.  The tenant chose to pay $366.09 to have Jacob Homes to remove the deck and thereby terminated any further obligation in connection with it and the lot.

       

      At the time the tenant and Jacob Homes settled accounts, the total amount owing, including rent for December 2019, was $835.28.  The agreed to additional cost to relieve the tenant from having to remove the deck resulted in a total outstanding balance of $1201.37.  The tenants security deposit of $300 was applied against that amount leaving a balance of $901.37.  On February 2, 2021, Jacob Homes received a check in the amount of $835.28.  It has written off the remaining balance owing of $66.09.
