I was hired by TSG Marketing LLC in March 2021 to do freelance graphic design work for their publication "608 Magazine". For the first 2 week pay period, I was paid a flat rate based on 39 hours worked, even though I worked 59 hours (20 hours of overtime). We then renegotiated my contract to reflect a larger base pay based on 30 hours of work per pay period. In the TWO pay periods following said renegotiation, I worked a total of 97 hours (60 base, 37 overtime), but received no compensation whatsoever for any of these hours worked. Aside from the fact that I never received any sort of compensation for the 57 hours of overtime I had worked over 3 pay periods, I still was only ever paid my base salary for 1 of these 3 pay periods. Between my base pay and overtime worked, TSG Marketing LLC owes me $4795 for 60 base hours and 57 overtime hours . After the third pay period had concluded and I still hadn't received payment, I contacted TSG regarding my missing compensation and was continuously told that a check was in the mail - however, no check ever arrived. While waiting for this check that never came, I received an anonymous message from another employee alerting me to the fact that there were multiple employees currently providing work for this company but not receiving any sort of compensation. At this point, I notified TSG that I would not submit any more work until they paid me for my already completed work. The "girlfriend" of the owner of the company (who claimed to be an "office liason") responded with a claim that I was in breach of contract for withholding my work and that they would be contacting their attorney. I never received any correspondence from TSG following the aforementioned text message exchange, nor did I ever receive compensation for those 60 base and 57 overtime hours.
