              Claim Number: ************* Insurance Carrier: California Automobile Insurance Company (Mercury Insurance)The insurance carrier violated CCP section 1280 et seq. and CIC section 2071, as well as the insurance policy, by denying my rights to appraisal. The carrier's reason, "appraisal is not the appropriate remedy for this dispute," is false, misleading, and an unfair or deceptive act or practice to cause me financial harm. The insurance adjuster is being aggressive and using delay tactics to avoid taking responsibility for payment.

              My car was hit by the 16 year-old kid of the policy holder. She said "I didn't see you! I didn't see you!". The night of the accident, the dad came to where we live to beg us not to file with insurance, but did not offer to pay for damages and rental car. When we said we were going to seek compensation through his insurance he got agitated stating that he would have the other kids in the car at the time of the accident "get their stories straight". I have filed a police report and a report with my insurance that both demonstrate the other driver is at fault and Mercury needs to pay for repairs and car rental.I also have photographs of damage to both cars which prove the fault is with Mercury's insured. I look forward to having the California Department of Insurance investigate Mercury for denying a valid claim in bad faith.
