On April 3, 2018 The Contractors State License Board filed an Accusation against Phoenix Energy and Construction. Charges filed allege the business is in violation of Business and Professions Code prohibiting abandonment without legal excuse of any construction project, departing from trade standards, violating building law-no permit, exceeding contract amount, failing to secure Workers Comp coverage for employees, misrepresentation to obtain contract, change order not incorporated in the contract, starts buyer's rights as to right to cancel, no notice regarding name & phone of liability insurance carrier, no notice regarding contractor is self insured w/ liability insurance, no notice as to not having employees and exemption from WC, no notice as to the name of the Work Comp carrier, no notice regarding additional/ changes in writing prior to work beginning, no notice: un-enforceability of change orders not complying, no notice as to limitation of unjust enrichment, no heading or notice as to the mechanic’s lien, no notice regarding the CSLB, did not provide a day right to cancel notice, did not include the 3 day right of recision language, no approximate completion date, no heading for a down payment, no space for the actual down payment, excessive down payment, no monetary amount noted for work performed, no payment schedule: payment exceeds value of work, no notice describing substantial commencement of work, no approximate start date heading, no date as to the beginning of work, no approximate completion date heading, failing to timely pay subcontractor, and fraud involving contract document.
