On June 27, 2022 Better Business Bureau contacted Extract Labs LLC concerning an advertising claims found on its website, https://extractlabs.com.
1. CBD Oil in Gummies, Pet food
- According to the FDA, it is currently illegal to market CBD by adding it to a food or labeling it as a dietary supplement, such as gummies, pet treats, etc. if you are shipping across state lines. It appears on your website you can ship these products across state lines.
2. CBD Oil implied health/cure claims
- The Federal Trade Commission is currently targeting claims such as these as part of an ongoing investigation of businesses marketing and selling CBD products. The FTC strictly prohibits companies from “making certain prevention, treatment, or safety claims about dietary supplements, foods, and drugs, unless they have the human clinical testing to substantiate the claims.”
3. Health Claims within Testimonials
- Advertisers should not include claims in testimonials that they themselves cannot make and support.
- When disease claims are advertised, it’s necessary to provide competent and reliable scientific evidence. The type of substantiation depends on the claims being made.
- In the case of health claims and CBD, substantiation would likely involve human testing that is blinded, performed by an independent third party, placebo-controlled, conducted on a sufficient scope of subjects, and has ideally been peer-reviewed.
4. Avoid Bioavailability Claims
- Claiming that your product is more bioavailable than others also requires human testing. Comparing the bioavailability of your product to others requires comparative human testing.
5. CBD Oil is not considered a supplement, so the FDA disclaimer does not apply.
- BBB’s Advertising Review Department is available to review claims included in your marketing materials to verify they meet the highest standards of truthfulness and transparency. Additionally, if necessary, we can supply alternative messaging to promote your CBD products.
- According to the Code of Advertising, advertisers bear primary responsibility for truthful and non-deceptive advertising. Advertisers should be prepared to substantiate any claims or offers made before publication or broadcast and, upon request, present such substantiation promptly to the advertising medium or BBB.
Despite written requests, as of March 22, 2023, Extract Labs LLC failed to substantiate or modify its advertisement.
