On 4/20/2023 our company driver, signed a Trinity Logistics rate confirmation agreement for the rate of $1,800.00 the rate confirmation was confirmed and sent by Trinity Logistics Broker - ******** ********. The rate confirmation stated for the load to be tracked which the driver made sure the load was tracked, the rate confirmation also stated that the load was a dedicated load only, which the driver complied and followed the instructions that was requested. On 4/25/2023 Trinity Logistics Broker - ****** ***** made a false claim stating that our driver partialed the load, which was a lie coming from Mr. ****** *****, our driver DID NOT partialed the load. Once the load was delivered in Phoenix, AZ my driver sent all documents including bill of lading to the factoring company Tafs and to Trinity Logistics. Trinity Logistics breached our contract and rate confirmation agreement. Trinity Logistics, Inc only paid our company $360.00 and they kept our payment of $1,440.00 for a load our driver delivered for Trinity Logistics, picking up in Arcola, TX going to Phoenix, AZ. ****** ***** lied and stated that our driver partialed the load, so that Trinity Logistics, Inc could keep 80% of our payment. If an ACH payment for $1,440.00 is not made to our factoring company, the carrier have the right to seek legal action, when a contract and agreement is breached by the Broker. Our company have already retained a business attorney. For non payment from Trinity Logistics, we will have our attorney and legal team to contact the shipper Maxim Crane 303 Peach Ln, Arcola, TX 77583 to collect payment in the amount of $1,440 for the delivery that was made on 4/24/2023 to ***** ***** **** **** *** ***** ******** AZ. If the carrier can not collect payment then a lawsuit will be filed against the Broker - Trinity Logistics, Inc and the Shipper - Maxim Crane for non payment of delivery which will include payment for our Court costs.
