This company bought my car over 6 months ago. Sent me a letter saying they owe me a refund. Now they never answer the calls or return them. I will not go away until I am paid what I'm owed. I have all documentation to proceed to court. If this is not resolved by September ****** I am moving forward with legal actions towards the companyInitial Complaint

I received a letter stating they had sold my vehicle and there was a balance owed to me that I need to call and collect. I called and they said it would arrive but nothing as of yet still. They are rude and liars.Business response

I received a car title loan in 2023 and was unable to make the payments. I voluntarily relinquished the vehicle and it was sold at an auction in October of 2023. From the date of sale I've reached out to the company to receive the check owed to me (approximately $5,000). I received a letter in the mail June 4, 2024 stating the check would be mailed after I made a call to claim. To date, I have not received the check and they can not provide a tracking number.Initial Complaint

My car was sold at auction almost two years ago. I received a letter about my money I have been calling and calling and calling its been almost 2 years! I want my money! This is ridiculous! We borrowed $5000 on the title of our truck. Our truck was picked up on 01/30/2023, auctioned on 02/28/2023. A check was mailed out on 03/01/2023. I received a letter that was dated 05/09/2023 stating that I needed to call to claim my money in the amount of $13,121.87. I called on 05/15/2023 to claim my funds. I have called many times after the initial call and to no avail I have not received nothing. Their response is that it is in the process and working on it. I have asked to speak to a manager and they are never available. I have left messages requesting them to call me back and they never returned my calls. I am so frustrated that I have not received nothing and it has been over a year. I am sure who it was that spoke to but I was told that they would call me when the check is mailed out. I was also told that they may not have the money to pay us. AND I WANT MY MONEY.Initial Complaint

Approximatley 8 ago I took out a title loan on my vehicle with loanmax in ****** Az , i only borrowed $1400 against my *********************************************************************************************************** ******* and had called in my payment one morning and when I went to lwave for work that evening my car was gone , after several phone calls I was told that it was repoed it by mistake because since the time zone difference in GA where the parent company is had a time difference than Az that they didnt get notice that the paent was made The car was returned to me the next day and i had a manager (whom i cant remember his name but hes the manager in the ************ location)apologize to.me and assured that i would not be charged any repo fees and my car would be returned to me the next day , the car was returned to mw the next *** and i said its ok it was just a mistake. Well then that month when i went to make my $150 payment i was informed by ******** the office manager yhat my paymemt was seven hundred and somthing dollars , I asked why and she stated that a repo fee was added to.my account , i explained to her the situation and she said well corporate changed their mimd and said you have to pay the money , i told them i wanted to speak tp the manager that i had spokem to before and she said theres nothimg he can do so i have not been able to catch up.ony payments and now i guess im just gonna have to let them have my car ,*** tried negptiating with them but they now want the full original payment along with all the interest that has aqurued and i dont feel that thats fair , they are just bullying me at this point i guesd im gonna have to let them take my car Please help me if you can. This company is not BBB certfied and i see why because they lie to their customers and put thier greed first.Thank you *************************Business response

Thank you for notifying the ******* of Mr. ******** complaint. We appreciate this opportunity to respond.
An investigation into the grievance proved the ******* committed no wrongdoing. On June 9, 2023, ****************** borrowed $1400.00. His loan was due in full on July 9, 2023. A review of Mr. ******** account reveals that he did not pay his loan off as agreed, nor did he submit the minimum amount needed to renew his loan agreement. Since ****************** failed to submit a payment after he obtained his loan, on August 22, 2023, the ******* repossessed its collateral. After the vehicle was repossessed, ****************** submitted a payment of $469.05. Thereafter, an employee (that is no longer with the *******) allowed ****************** to redeem the vehicle even though he did not pay his account off in full.
The ******* operates in strict compliance with state and federal laws and has committed no wrongdoing. We are sorry that ****************** is upset,however, he defaulted under the terms of his contact and the ******* had the right to repossess his vehicle and charge him the towing fees it incurred to take possession of its collateral. Unfortunately,****************** has not submitted a payment since February and his account is extremely past due. With that said, he should contact the ******* at ************ to make payment arrangments as soon as possible.

I am rejecting this response because:The payment was made and their manger aka employee that does not work there anymore admitted that the payment was made and the repossesion should not have happened , and now they are not willing to work with me because that employee manager is no longer with the company , i believe that the manager aka former employee was being honest , but my point is that he was a manager at that time and made a management decision so reguardless of weather hes still currently employed or not should be irrelivant , I want to hold this company liable for their former employees decision
So i want the repo fee dropped and all the intrest that has aquired since that charge to be dropped because of that charge is the only reason i got behind on my payments

****************** had two loans with the company in 2023. One loan was secured by his 2014 ****** RAV4 and the other loan was and is secured by his 2005 ***********. On August 21, 2023, ****************** paid the loan secured by the ****** off in full. However, as stated in the previous response, he had NEVER made a payment on the loan secured by the ***. Accordingly, on August 22, 2023, the company repossessed the ***. On August 23, 2023, he contacted the company and stated that the company repossessed the ******. Based on his statements, the former manager released the *** back to him after he submitted a payment (but, did NOT pay off that loan). If that manager informed ****************** that the towing fees would not be charged, it was because the manager believed the ****** had been repossessed - which was not the case. Instead, the *** had been repossessed due to Mr. ********* failure to pay as agreed under his loan agreement.Customer response

So If I understand this correctly the manager now stated I told him it was the ****** . I never stated that it was the ******. I had already paid that loan off in full and the ****** was located in ****** at the time with my wife anyway. I was in ******* with the *** when it was repoed further more I spoke to the Repo employee when he returned the *** to me the next day because i was very curiuos how they found the *** when i was at a friends apartment complex in ******* not even in ****** . He then stated to me that they always drive through that complex and run plate numbers and if they get a hit then they reposess , so my question is because they go stricky off the plate and vin # of the vehicle that corprate
How could it possibly be the ****** that was repossed because thr ****** has a different plate and vin # So right away the tow truck driver would know that its the wrong vehicle and would not proceed at that point because the Tow truck driver stated to.me that he verified that the *** had the correct plate and vin number so they proceeded with the reposession. This proves that even if I had stated it was the ****** which i never did then Corporate which is the one who sent the information on the *** not the ****** so it reallydoesnt even make scense that he thought it was the ****** , does corporate even communicate with their managers when a car is being repossed ??? Or shoukdnt the manager have that information on the computor beforehand ????
And also another question that I have if your manager believed that the ****** got repoed because I supposidly told him that. then why wouldnt he immediatly call the tow company and simply asked hey what did u reposess a *** or a ****** ?? Hmmmm guess he just took my word on it and thougt I was getting the ****** back so he approved for them to brimg back my Toyota he could of also confirmed with the tow company that it was a ****** or a *** before returning it to me. This doesnt even make any scense .
I also explained in the last letter that the payment was made before the repo but because of the time zone differnce in ** where the corporate office is the repo company didnt get the message to not repo because it had been paid , the manager apologozed to me and said the car would be returned to me the.next day which it was and that i would not be charged any repo fees. At no time during our conversation did the ****** come up .
When i went to make my payment the next month i was told my payment was $800 and somthing dollars I asked why and they stated to me that it was for the repo fee , i explained the conversation to the girl at the counter and all she told me was well theres nothing we can do because corporate said you have to pay it . So i asked to speak to the manager and they said he wasnt available and then asked for his phone number in which the girl replied well theres nothing he can do either but ill give you his number anyway .So i called several times with no answer and there was not even an option to leave a message. Wow very professional of them to blow me off when I was trying to resolve this matter.
Please know that i have paid off several tilte loans with this company over the years and they have always been honest kind and professional until now.
Here is what i will offer to keep the car but FYI
the car is no.longer running , the timing belt broke while i was driving down the road and since the *** ** engine is an interferrance engine it ruined the cam shafts so it will need a new motor or a rebuild Lucky for me my cousin is an Ace Certified mechanic and made this diagnoses for me after pulling the heads. Since I am family he will rebuild the engine for me for at a very low price which makes it worth it .
I am willing to renegotiate a settlement payoff of $1800 in 9 monthly payments of $200 thats $400 over what I Borrowed in addition to all my other payments , I think that is more than fair for a non running car and for all of the mis information that I had to deal with. if the company does not want to accept my offer then they can just come and tow the car, i feel that this payment they were demanding was unjust and unfair and this was the only reason that i got behind in my payments. The manager was very unproffesional and would not even accept or return my phone calls and the reason he did not want to talk to me is because he made a mistake and got in trouble with corporate ( ie he is now a former employee ) then tells a flat out lie that I stated to.him that it was the ****** that got repoed , I would love to hear a recording of me making this statement but i know that is impossable because I never made that statement to anyone.
Im an honorably discharged combat veteran and a police officer for 5 years and am now a retired Firefighter/Paramedic so i feel that my word should mean something .
I also have very close contacts with Kgun 9 on your side which is a local *********** station and 9 on your side is basically about the big corporate companies taking advantage of the little guys and warning consumers about certain companys that participate in unethical practices.
So please let me.know what their decision is.
I also wanna say thank you to the BBB for accepting my complaint. I feel that business that are accredited by your company have nothing to hide and puts the customer 1st and treats them right. It is my understanding that this company is not accredited with the BBB.

As previously explained, the company operates in strict compliance with state and federal laws and committed no wrongdoing. Again, the company repossessed its collateral (the **** because he had never made a payment after he obtained that loan. Therefore, repossession fees were added to ********************** account that was secured by the Kia. Notwithstanding the above, the company is willing to make a good faith effort to resolve his complaint. With that said, if ****************** would like to discuss a mutually beneficial settlement arrangement, he should call *******, the company's Assistant General Counsel at ************ by May 29, 2024. I have tried numerous times to contact them and to no avail I have not had a response even after 22 voice mails and speaking to ***** in HR.....It has been almost a year, this is ridiculous....I WANT MY MONEY!!Business response

On 6/8/2020 I was mailed a letter saying my car was sold at auction. The total balance on my loan was $1118.25. The car was sold for $1700.00. It says the amount due to me is $581.75. The date is now April 15 2024 and I have yet to receive my payment. Everytime I call to inquire about it they say it's processing. And they don't have anymore information for me. I'm beyond frustrated and I just want my money. Why does it take 4 years???Business response

This company has been taking ****** out of direct Express dibit card since Dec 2023. They took this *** off of my card index 2023 .Jan. Feb March 2024. I don't know this company and did not authorize these debits. This is my social security benefit money. I reported this multiple times to direct express without resolution.i am on a fixed income and this is causing me financial stress. There is number after their name on my statement ***********.I don't know what this number means.
