On April 8, 2013 Cook County State's Attorney Anita Alvarez announced that she has filed a lawsuit under the Illinois Consumer Fraud and Deceptive Practices Act, the Illinois Roofing Industry Licensing Act, and the Illinois Home Repair and Remodeling Act against Dupage County Roofing, and individually named Danny L. Stokes a/k/a Frank Mazzi a/k/a Anthony Mazzi.
Alvarez alleges that Danny L. Stokes a/k/a Frank Mazzi a/k/a Anthony Mazzi
known as "The Defendant" is and was, at all times relevant hereto, misrepresented and/or held himself out to consumers as a licensed, or otherwise qualified, roofing contractor, in violation of Section 2 of the Consumer Fraud Act; took receipt of a substantial down payment after executing a contract he could not lawfully perform, in fact did not perform, and retained the consumer's deposit, in violation of Section 2 of the Consumer Fraud Act; made false promises and false guarantees in relation to contracted roofing work he knew he could not lawfully perform, and /or he did not intend to perform, in violation of Section 2 of the Consumer Fraud Act and failed to refund payment made under a consumer contract within ten business days of a valid notice of cancellation having been mailed to his stated business address, in violation of Section 2B (f) (i) of the Consumer Fraud Act.
Alvarez also alleges that The Defendant entered into an agreement involving $25 or more for home repair and remodeling services while physically present at the residence of a consumer. The Defendant provided a consumer with a written contract that did not include, at the time of execution, a statutory "Notice of Cancellation", which completed copies of a cancellation notice form attached in duplicate to the contract.
Alvarez alleges The Defendant did not orally notify a consumer of the right to cancel the contract within three days of the time of execution. The Defendant did not provide a copy of a "Home Repair: Know your Consumer Rights' pamphlet and an acknowledgement form, prior to the execution of a home repair and remodeling contract over $1,000.00. The Defendant also did not provide a consumer with a written contract for home repair or remodeling over $1,000.00 that stated either a business address, or a residential address with a post office box.
Alvarez is seeking that the Defendant pays restitution to members of the public damaged by the Defendant's violation of the Home Repair and Remodeling Act. Assessing against the Defendant a $50,000.00 civil penalty, and costs for the persecution and investigation of this action.
