BBB promotes truth in advertising by contacting advertisers whose claims conflict with the BBB Code of Advertising. These claims may come to our attention from our internal review of advertising, consumer complaints, and competitor challenges. BBB asks advertisers to prover their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.
On 12/2/2022, BBB contacted Empire Today regarding their TV commercial offer that stated:
"Update your floors with Empire Today's $50 room sale. Buy one room. Get floors for all other rooms for $50 each. So, when you buy one room, it's just $50 for laminate in the kitchen, $50 for carpet in the bedroom, and $50 for hardwood in the office. There's no limit. Buy one room and it's $50 for each additional room."
"Product only. Select styles. Buy highest value room at regular price. $50 price excludes install, pad, and materials. Not available in all areas."
The BBB requested additional information about the offer as a complaint was received that a consumer was not able to receive this offer.
BBB Code of Advertising states (in part):
1. Basic Principles of the Code
1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
1.2 Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used.
As of 12/17/2022, Empire Today has provided an extensive response to the BBB about the offer and how it is not available in states where they do not offer promotions. The ad's disclosure clearly states that promotion is not available in all areas. The consumer is in a state where Empire Today does not offer any promotions and all products and services are on a fixed rate. The BBB finds that the company has addressed the concerns and that they meet the BBB Code of Advertising.
