On July 24, 2024, I contacted ****** ******* ofTop Quality Landscaping, **** ***** ***** ***** ***
*** *********. His company was referred to me by ***** **** **** ***********. I stated that I wanted
pea gravel for a 3 ft by 12 ft area which is the area on the right side ofthe house where the gas meter is located. I stated that because the gas meter is in that area, no digging could be done without contacting "***** ****** *** ***". I also said that I wanted an edger on the inside ofthe fence so that the pea gravel
would not seep out. (this part ofthe conversation is not what was sent in the text ofthe recorded
conversation.).
He told me about a plastic edger that could be used that would not require digging; he also mentioned
digging a trench for the pea gravel to sit in; I did not agree to digging a trench. He stated that it would be
$50 extra for the edging and the weed control fabric, which I agreed to. He did not record all the
conversation, but attached is what he sent in the text (Exhibit A, recorded text). We agreed on a date
for him to do the job for August 2, 2024.
After he finished the job, I looked at it and asked him to smooth out the pea gravel because it was very
uneven. After he corrected it, I looked it over again and it seemed to be better, so I paid him. It was not
until the next day that I saw a piece ofthe weed blocker fabric sticking out from under the pea gravel and
pea gravel seeping under the fence. I moved the pea gravel aside in different areas to see how the weed
blocker fabric was laid in those areas, and it was also folded and crumpled in those areas.

I texted ****** and told him I was unhappy with his work and wanted it corrected. His reply was he
would only be spending 20 minutes to correct the job. I told him that he needed to stay until it was done
correctly, and that If he did not want to do that, I would pay him his labor, but I wanted a refund. He
offered $25, which I originally accepted, but then decided not to accept a check and that I would file a
complaint instead. (Exhibits C, Cl-C4
It will cost me $350 to have it redone, see estimate from **** ***********. They have to remove all the
pea gravel from the weed-control fabric, put in a new weed control fabric and reinstall the pea gravel..
