I solicited for quotes on BBB for a porch and deck roof installation within 90. Powell Contracting Company Inc. (*****) responded. We signed a contract and part of the contract was that if I was not able to gain HOA approval, my deposit would be refunded. After waiting weeks for the contractor to put me on his schedule, he finally told me on 6/10/22 that he would start my project on 6/13/22. I went out and removed my deck furniture, however Powell did not show. At 11:20 on 6/13/22, I texted Powell and asked if he was still coming to start my project and he texted back yes, this afternoon. At 4:08, Powell texted me back stating "the day got away today" with no mention of when or if he would reschedule my start day. I had advised Powell that I needed a drawing of the porch dimensions for final HOA approval starting on or around May 2022. I repeated this message of the HOA requirement to Powell in a text on 6/13/22. I did not receive a response but Powell claims that he showed up to my house on 6/15/2022 unplanned and unexpected with papers. I was working and was not able to meet with him. Powell had previously left papers on my stoop under an ornament and could have left the drawings also. I asked Powell again for the plat drawing and he stated he would not give it to me as he felt I was no longer committed to the project since I went back on BBB to solicit the deck roof job again on or around mid-June due to a lack of communication from Powell. However, as I told him, I was still committed to allowing him to complete the porch project. After Powell stated he would not give me the drawing in an email, I asked for a refund of my $600 due to breach of contract. After several emails back and forth requesting my refund and having to inform Powell I would be filing a civil suit and complaints, Powell emailed me on 7/7/22 that he put my check in the mail when he got home. Bel Air is less than 45 miles from my home and to date, I still have not received my deposit back.
