The Consent Order settles a Licensing Order, issued by DLI on August 17, 2022, that alleged the business failed to reasonably supervise employees, agents, subcontractors or salespersons ,has performed negligently or in breach of contract so to cause injury or harm to the public, in violation of Minn. Stat. § 326B.84 (4) (2020); engaged in fraudulent, deceptive or dishonest practices when they repeatedly performed construction without obtaining building permits, failed to comply with approved building plans, and engaged in false, fraudulent, or misleading advertising, in violation of Minn. Stat. §§ 326B.082, subd. 11(b)(8), 326B.84 (2) (2020) and Minn. R. 2891.0040, subps. 1B and 1H (2021) and demonstrated incompetence, untrustworthiness or financial irresponsibility instructions and recommendations for the installation of footings; failed to comply with correction orders issued by permitting authorities; failed to 2 pay subcontractors; repeatedly misled Minnesota property owners and permitting authorities; abandoned customers projects for months; and diverted customer’s payments from their intended purposes, a violation of Stat. §§ 326B.082, subd. 11(b)(9), 326B.84 (15) (2020), and Minn. R. 2891.0050, subp. 1C (2021). The Licensing Order also alleged the business failed to respond to DLI’s requests information by providing a response that was false, misleading, or incomplete, in violation of Minn. Stat. §§ 326B.082, subd. 11(b)(2)(6) and 326B.84 (14) (2020). The Licensing Order further alleged the business failed to include a contract price on their contract with a homeowner, in violation of Minn. Stat. § 326B.809 (2020) and failed to maintain records showing all contracts, records, receipts, and disbursements for a period of not less than three years after completion of any construction project, in violation of Minn. R. 2891.0020 (2021). The business further violated the November 24 2021 Consent Order with DLI, by failing to comply and engaging in fraudulent, deceptive or dishonest practices, failing to reasonably supervise employees, agents, subcontractors or sales persons, performing negligently or in breach of contract, demonstrating incompetence, untrustworthiness or financial irresponsibility, failing to maintain records, failing to include contract prices, and failing to cooperate with DLI’s requests for information, a violation of Minn. Stat. §§ 326B.082, subd. 11(b)(5) and 326B.84 (5) (2020).
Under terms of the Consent Order, the business agreed to revocation of their residential building contractor license and the qualifying builder registration for Caden Fritz and to cease and desist from acting or engaging in residential building contractor, remodeler and residential roofer activity in Minnesota. The business also agreed to satisfy court judgements; issue refunds and cooperate with customers attempt to seek compensation for the Contractor Recovery Fund. The Licensing Order of August 2022, is vacated. In addition, the monetary penalty of $32,500.00 is stayed contingent on the business's full compliance with the terms of the Consent Order and compliance with all laws, rules or orders entrusted to DLI.

Under terms of the Consent Order, the business agreed to cease and desist from acting as or engaging in residential building contractor or remodeler work in Minnesota until all required licenses and registration are obtained and pay $7500.00 of a $10,000.00 penalty, with the balance stayed on the condition the business does not violate the terms of the Consent Order in the future.
