MERZ advertises a program named XEOMIN Patient Savings Program. This program claims to reimburse out-of-pocket expenses associated with using their product during medical procedures. However they have refused to fully reimburse my expenses, despite my doing everything properly (I enrolled in their program, ensured my neurologist used XEOMIN, filed for reimbursement in a timely manner, etc.). When I first filed for reimbursement, they rejected my claim with a mailed letter that provided the reasons of 'Other' and 'Other.' Literally their letter had 2 bullets of reasons the claim was rejected, and each bullet said 'Other.' Please see a copy of this letter in the attached document. When I re-filed the claim per their instructions, they reimbursed me only $323.62 of $1939.77 total bonafide expenses. They have never explained why they rejected the remaining amount, and in fact one of their representatives (**** or *****) confirmed that I had filed correctly and should've been fully reimbursed. After months of phone calls and faxes to them, I hired an attorney to send a demand letter, which they have ignored. At this point I consider their program and advertising to be fraudulent and have also filed a complaint with the Attorney General's office. If their program is not fraudulent then they owe me reimbursement of $1816.15 to include full reimbursement of out-of-pocket expenses and $200 in legal fees attempting to resolve this directly with them.
