I contacted Roger A**** for an estimate and he came over to look at the roof. I paid him a deposit of $2000 through ****** to lock in the price of shingles, as he said the shingle price was due to go up. I charged my ******** *******. He told me upfront that he doesn't do insurance work, adn in any case, insurance would never approve a claim on the roof as it was wear and tear.
Then I called my insurance company, Westfield. They sent an inspector. I filed a claim which was approved due to high winds, rain and snow.
I did not receive a written contract from Roger. He was supposed to replace the roof with shingles. He was supposed to start the job in April.
Within 24 hours, I told him my insurance company has approved the claim, and they will have a contractor come out, and to please refund my deposit on 3.2.23. He texted to say he would call me back to let me know when he could return my money.
Then he asked me to give him until Friday, and he would try to get the funds together even if it came out of his pocket. Then he said he would be over the following Friday. I called to ask if he was coming, he said he was still trying to figure it out. At 4p he texted to say he was still trying to figure it out.
At 5p I called Roger, and asked him what happened. He said he was waiting for an insurance check from another lady, but it never came through. I said we are both waiting for our money. He said she's saying she won't get the funds until next Tuesday. He also said he would charge me a 30% restock fee for the shingles he ordered. I never signed anything, there was never a mention of a restock fee.
I explained that I needed the money to pay my insurance deductible. So I was filing a dispute through my credit card. He said he would not dispute the credit card charge back.
****** said they would not assist me. My credit card has an agreement with ******.
He is clearly not following the three day cooling off rule, as I requested a refund within 24 hrs.
