State of Ohio Attorney General Dave Yost v Augustin A. Musisca Custom Construction Co and Musisca & Sons Construction LLC
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

On October 31, 2024 the Ohio Attorney General Dave Yost filed a lawsuit with the Carroll County Court of Common Pleas against Augustine A. Musisca d/b/a Musisca Custom Construction Co. and Musisca & Sons Construction, LLC who allegedly contracted with consumers to provide home improvement and construction work, and represented they would complete the improvements and construction services within eight weeks, took money from consumers for the purchase of goods and services, and failed to complete the work and failed to correct such services. Musisca also allegedly failed to provide refunds when the work was not completed, and filed to obtain the required permit and registration with the required municipalities prior to starting the work.  Charges filed allege the business is in violation of the Ohio Consumer Sales Practices Act (CSPA).

The action seeks order the Defendant to pay actual damages to all consumers injured by the Defendant, a civil penalty of up to $25,000 for each separate violation of the CSPA, issue an injunction prohibiting the Defendant from engaging in business as a supplier in any consumer transactions the state until the Defendant has satisfied all monetary umbilications ordered by the court, pay the Plaintiff its costs incurred in bringing this action, and order the Defendant to pay all court costs.
