The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.
On Aug. 20, 2024, the Ohio Attorney General’s Office filed a civil lawsuit in Franklin County Common Pleas Court against defendants Liberty Restoration, LLC, Liberty Exterior Design, LLC, and Joshua T. Basinger, accusing them of ghosting homeowners after accepting payments totaling $158,000 for repairs, in violation of the Ohio Consumer Sales Practices Act and the Home Solicitation Sales Act.
According to the state and the lawsuit, the business sold home-repair services in storm-damaged areas, accepting deposits either directly from customers or through checks from their insurance companies. Consumers complained that Liberty Restoration failed to make the promised repairs or performed shoddy work, then dodged consumers’ subsequent attempts to contact the business. The state and the lawsuit further assert that the company agreed to issue refunds but never delivered on that promise.
The state seeks restitution for consumers, civil penalties, and an injunction preventing Basinger and his business from continuing to violate the law or doing business until restitution is paid.
The matter is pending before the court.
