Contract #********* dated 7/29/2020; revised 10/1/2020 & signed by me 10/4/2020. The revised contracted amount was $32,950. Including a $3,000 deposit paid in 2020, I paid a total of $26,032.50. The work didn’t start until July 2021. The problem that needed fixing was that the brick pillars on either end of the porch were leaning. The front porch had been added to the house without footers. (The home itself is 825 sq. ft.) The Jamison representative told me the entire porch needed to be demolished & footers installed. The original porch roof would remain. The contracted agreement was to demolish the front brick porch with 2 columns, insert footers and rebuild to the porch to same dimensions, keeping the porch roof. • Porch was not built to same dimensions. The already very small porch is now 2 inches shorter in depth. • Because the depth of the porch is 2 inches shorter, the steps to the front door are not as deep (front to back) as they were. They were also built uneven in height. • The wall on the left side of the steps is too wide. It was supposed to be 9 inches; it is 14 inches. Because of that error, the wall runs 7 inches under the hinge-side (left side) of the storm door and made the steps narrower (left to right). There now is an “overhang” on both sides of the steps. This also encroaches on having enough clear access to the doorway and to the porch. • There are 2 windows that lead under the concrete floor of the porch to the cellar of the house. They were not put in at the time stipulated in the contract. Consequently, I was told (after the fact) they could not be installed in the locked position. So, they were installed un-locked & left unlocked. They remain unlocked. I cannot fit under the concrete floor of the porch, to lock those outside street-level windows.Business response

The following emails summarize, to an extent, the most recent communications between *** ******, myself and my project manager, Dennis L***. The first was written by me on 9/16/21 to *** ******. The second email is from Dennis to *** ******; sent on 9/1/21.
The nature of her complaint, at that time, had to do with the overall dimension of the finished project. Admittedly, it was slightly larger than the original, but this can happen, and often does, when we're dealing with masonry that was originally installed over 100 years ago. The vast majority of this project went just as well as every other project we perform. Our reputation is stellar, and it matters to me. I do not believe there can be any resolution to her complaint. As I indicated in my email to her, we will not rip out the entire project to correct what, in our opinion, is a defect that dates back to the original installation. The other, minor items she mentions would have been corrected to the best of our ability IF she agreed to pay the balance of her contract - $6917.50. She has refused, so we have no choice but to refuse to come back.
At a minimum, it is an unfortunate situation. By the end of this year, we will have completed nearly 2500 projects for clients throughout the Greater Delaware Valley area. This is one of only three projects that have resulted in dispute.

I am in receipt of your letter and email. I have discussed this project at length with Dennis.
As he stated (in his email below), we will not re-do the brick work. The work that our foreman, Robert, completed is very sound. We realize the final dimensions are different from the original, but this can happen when restoring very old construction.
You have since stated that you are seeking a quote from “another contractor to remedy what Jamison's did not do correctly.”
While Dennis has offered to correct a few minor items, that was with the understanding that we would be paid for the balance owed on this project. My gut tells me that no matter what we do, short of ripping out all of the work and re-doing it, there is very little chance we will be paid.
So, I am forced to conclude that we must walk away from the remainder of this project. I am sorry that you are so clearly unhappy with the work we’ve completed. I’ve reviewed all of the project photos, and I think the work looks very good, which is reflective of the many years of experience that Robert has, and the many satisfied clients whose projects he has worked on.EMAIL#2, from Dennis to *** ******:
After having an in depth conversation with the president of the company, Steve W******, we are not removing all the work we completed in order to move the porch out a couple inches. This would cost the company a substantial amount of money that we both find unnecessary. We are willing to return and complete the other issues we discussed as far as caulking in the areas of concern, minor brick pointing that was not completed to your satisfaction, attempting to lock the windows that were installed below the porch, and we will clean all the new brick work again. At this point we will have the final invoice for you and final payment will be due.

I am rejecting this response because: Jamison's owner is wrong in many areas.Project was built SMALLER NOT LARGER than original, nor per contract
The original porch’s masonry was NOT over 100 years old.
I was told they would do no more.
I never refused final payment. Mr. W****** wrote “his gut” told him I wouldn’t pay a final invoice. Now he states that’s the reason for not completing
They contracted to build the porch the same as the original & didn’t.Regards,
