BBB promotes truth in advertising by contacting advertisers whose claims conflict with the BBB Code of Advertising. These claims may come to our attention from our internal review of advertising, consumer complaints, and competitor challenges. BBB asks advertisers to prove their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.
On October 21, 2022, BBB contacted Iclyn's Sassy Scentsation regarding its use of the term "Only 1 left" on their items and advertising they offer "discontinued fragrances."
BBB Code of Advertising states an advertiser must have on hand a sufficient quantity of advertised products to meet reasonably anticipated demands unless the advertisement clearly and conspicuously discloses the number of items available or states “while supplies last.” If items are available only at certain locations, sites or stores, the specific locations, sites, or stores must be disclosed. The use of rain checks is not a justification for inadequate estimates of reasonably anticipated demand.
BBB requested Iclyn’s Sassy Scentsation to substantiate and/or clarify that there is only one of each item on their website for sale and the item is either discontinued from their website after it is sold out or the product page for each item is updated to disclose the item is no longer available.
Iclyn's Sassy Scensaction also advertised they offered discontinued fragrances.
BBB Code of Advertising states advertisers must not describe products as “discontinued,” “discontinued model,” or by using words of similar import unless the manufacturer has, in fact, discontinued its manufacture of the product, or the retail advertise will discontinue offering it entirely after clearance of existing inventories. If the discontinuance is only by the retailer, the advertising must clearly and conspicuously disclose that fact, for example, “we are discontinuing stocking these items.”
BBB requested Iclyn’s Sassy Scentsation to substantiate and/or clarify that the fragrances are in fact discontinued or discontinue the advertisement from their website. The business discontinued the advertisement to address BBB's concern.
As of November 18, 2022, Iclyn's Sassy Scentsation discontinued the advertisements to align with the BBB Code of Advertising.
