      We purchased a new home through Newark in July 2020. During our initial walkthrough, I noted our back door not sealing properly and our egress being broken. A Newark employee attempted to fix the door seal, breaking the door stopper, and never properly sealing the door. They also re-bent the egress thinking that addressed the issue. We are unable to put a cover on it due to it being bent. During our one-year checklist, I noted that it seemed like our master bath was leaking into the drywall. A Newark employee came in and painted over the mold spot. We recently had a contractor come in and tell us that our shower was improperly sealed and will cost $15,000 to replace. This past weekend, we noticed water was dripping from our ceiling in the garage causing significant damage to the drywall. As we continued inspecting the house, we noticed paint streaking in several places in the garage. We also noticed a leak in the corner of our guest bedroom. My husband climbed up onto the roof and into the attic and found that several areas in our roof are leaking causing damage. We would like Newark to either repair all of the damages or pay for someone else to repair the damages.

      1) Back door not sealing properly: This issue was addressed on the one year punchlist from 2021and we hadn't heard anything different since completion.

      2) Egress window well being broken: This item was on the buyer's initial punchlist and this item was addressed prior to closing. On the buyer's one year warranty they did not address any issues with the window well.

      3) Master bath leaking into drywall: Per builder's contract "This warranty does not cover ordinary wear and tear, neglect, alterations, remodeling, misuse abuse or general maintenance on the building." This issue is related to the installation of the shower doors which was an alteration completed by the buyer's after closing.

      4) Roof leaking: Any roof issues that were brought to our attention (on or before the home warranty expiration) were addressed.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      1) Back door not sealing properly: This issue was not addressed properly. I was at work when the H3****4353930363**836H employee installed the new seal, and the employee never asked my husband to check the door prior to leaving. The employee broke the door stop, the new seal is broken, and the door sticks. H3****4353930363**836H must address this issue.
      2) Egress window well being broken: This item was not addressed properly. Bending the well did not fix the problem. I did not bring this up again during our one year punchlist because it was not addressed the first time. H3****4353930363**836H must address this issue.
      3) Master bath leaking into drywall: This is incorrect. This is a three-piece shower. Where the pieces come together was not appropriately sealed and is leaking into the drywall. Water is getting into the back side of the shower walls and is now showing along the side where the door was installed. This was identified as an issue prior to the door being installed. We didn't install this door until living in this house for almost one year. H3****4353930363**836H must pay the difference for the replacement of our shower. Our neighbors are having the same issue and only have a shower curtain installed. This is not due to the installation of our shower door.
      4) Roof leaking: H3****4353930363**836H should stand by their work for more than one year. We have not had any major storms and have not had any damage to our roof. There should be no reason this roof is leaking. During the heavy rain over the weekend, my husband went up into the attic to see that our roof is leaking in THREE different places, in each of our guest bedrooms and our garage. H3****4353930363**836H must either repair these leaks or pay for us to hire a different contractor to fix the leaks. They have clearly been leaking for a significant amount of time if they are now showing up inside our garage and one of the bedrooms.

      This is regards to complaint # ********. I located our addendum with Newark Home builders from 2020 prior to closing on our home. In our addendum, we identified mold in the master bath towel closet (#**). This closet shares a wall with the garage where it is currently leaking. The builders did not go up into the attic to confirm this was not due to a leak, as requested, and painted over it. We also identified the stain in the corner of our guest bedroom (#**). The builders, again, did not go up into the attic to confirm this was not due to a leak and painted over it. 

      It is highly likely that our roof has been leaking for the two years that this house has existed since these areas are both of the areas in which our roof is currently leaking.

      On October 1st 2021, I closed on my new house. At this closing the realtor and construction representative were present and told me that the house was ready but sidewalks were not done. The construction company said the sidewalk would be done by November 30th. And asked me if I agreed to wait. I agreed and signed all documents for closing. My neighbors sidewalks were done except for mine. I waited for this date November 30th because this was the agreement but only mine have not been done, is it because Im Hispanic? And my English is not perfect? I have complained to my realtor and to them and I got an email stating they would not be doing the sidewalks because of weather but I cant believe if construction is their business, why werent they able to figure out if they would be able to do it or not. I dont trust them and I believe they will not do it and I want to secure the money to be able to do it, so I want to be reimbursed the money for doing this job or secure a document from them where they state exactly the date when this job will be done and that I will not owe them nothing. I havent gotten any response to my problem yet so I need BBBs help to have this business correct their ways. Im attaching this document my realtor had me initial on item number 17, which you can see my initials. My realtor send me this document with number 17 crossed and ***** were added by her but I never agreed to have number 17 scratched or to the ***** additions. The realtor is ******************************* , broker for ***********************.

      This location was on the schedule but the blacktop plant that we use had closed for the winter and wouldn't open again until Spring of 2022. Fortunately, we were able to find another blacktop plant that was still open and they were able to complete the sidewalk for the homeowner on December 2, 2021.
