I purchased a painting from Art & Antique Gallery with a "Buy Back Guarantee" (BBG), which I have in writing on the original receipt with no expiration date. The person that I dealt with and that wrote the receipt was/is the owner of Art & Antique Gallery. The BBG is part of the reason I purchased the painting. When I contacted the owner informing him I wished to invoke the BBG he refused and said he "reorganized" and no longer honors the guarantee. He has since ignored my calls and emails to try and resolve the issue. Just because the owner/business has decided to no longer issue BBG's does not make the ones he did issue null and void. The business still operates under the same ownership, out of the same address, under same business name, same tax id, same email, etc as he did when he sold me the painting, so there has been no "reorganization". And even if there had been, legally his BBG remains legally binding and there is no statute of limitations. This is not the type of person/business I would encourage anyone to do business with. The owner/business does not honor his/its own handwritten guarantees, indicating he/it is untrustworthy and deceptive. Being a certified appraiser, the owner is held to an ethical and professional standard which I would think he has not meet in his business dealing with me. I will be informing the appropriate Boards of his actions and practices in my dealings with him. I have documentation for all that I have stated herein and have shared with the owner and the BBB. I purchased a painting in good faith, and expected the business to honor their BBG in good faith. Apparently Art & Antique Gallery believes that their own handwritten "guarantees" are not worth the paper they are written on. If you can't count on that, then again, I believe it is not a business you should do business with. I would have given a rating of ZERP stars but the website will not allow that.
