The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.
On Nov. 18, 2022, the Ohio Attorney General’s Office filed a civil lawsuit in Franklin County Common Pleas Court against defendants Daryl Renard Allen individually and dba Good News Builders, and Bernard Crist individually and dba Good News Builders, and Shane Michael Bates individually and dba Good News Builders, and Columbus Deck Company, LLC. They allegedly violated the Ohio Consumer Sales Practices Act and the Ohio Home Solicitation Sales Act.
The Ohio Attorney General’s Office stated that homeowner complaints – one against Columbus Deck Co. and 11 against Good News Builders - detailed financial losses totaling $132,139.80, and alleged that defendants failed to deliver promised goods and services, or performed shoddy work and failed to correct it. Daryl Allen was previously in trouble with the Attorney General’s Office for shoddy home-improvement work, and had been prohibited from doing business, and had a history of setting up a new company after consumers complained, and Allen is currently accused of teaming up with Bernard Crist and Shane Bates, through two companies they operated – Good News Builders and Columbus Deck Co. LLC, related to the current lawsuit, according to the state.
The lawsuit is seeking an order requiring the defendants to reimburse customers and pay civil penalties and court costs. It also requests an order preventing the defendants from engaging in business as a supplier in any consumer transactions in Ohio until those debts are paid.
The matter is pending before the court, with a trial assignment of 12/18/23, according to the information we have at this time.
